DENİZDE ÇATIŞMAYI ÖNLEME TÜZÜĞÜ 

Denizde Çatışmayı Önleme Tüzüğü kuralları uluslararası uygulamalardır.

Denizde çatışmayı önleme kurallarına uyum:

Açık denizlerde,
Açık denizlerle bağlantılı olan sularda,
Açık deniz teknelerinin seyredebileceği sularda seyir yapan tüm tekneler için zorunludur.

Ülkeler bu kurallara ek olarak; Karasularındaki şartlara uygun, farklı
ek düzenlemelerde bulunabilir.

Ülkelerin kendi içsularında veya yüzer araçlar ile ilgili koyduğu özel kurallar, mümkün olduğunca bu uluslararası kurallara aykırı olamaz.

BÖLÜM A – GENEL

KURAL: 1
Uygulama

(a)     Bu kurallar, açık denizlerde ve açık denizlerle bağlantılı olan ve açık deniz gemilerinin seyredebileceği sularda bulunan gemilerin tümüne uygulanacaktır.

(b)     Bu kurallarda bulunan hiçbir hüküm, açık denizlerle bağlantılı olan ve açık deniz gemilerinin seyrettiği demir yerleri, limanlar, göller, iç su yolları için yetkili makamlarca yapılan özel kuralların çalışması ile çelişki halinde bulunmayacaktır. Bu gibi özel kurallar, olanağı nisbetinde, bu Kurallara uyacaktır.

(c)     (Değişik: 20.9.1984 - 84/8541 K.) Bu Kurallarda bulunan hiçbir hüküm, herhangi bir Devletin Hükümeti tarafından savaş gemileri ya da konvoy halinde ilerleyen teknelere özgü ve istasyon ya da işaret ışıkları şekilleri ya da düdük işaretleri, ya da filo halinde balık avlayan balıkçı teknelerine özgü ek istasyon, ya da işaret ışıkları, ya da şekilleri için konulan özel kuralların işleyişine müdahalede bulunmıyacaktır. Bu ek istasyon ya da işaret ışıkları, şekilleri ya da düdük işaretleri, olanaklar elverdiğince, bu kurallar altında başka yerlere konulmasına yetki verilen ışık, şekil ya da işaretle karıştırılmayacak şekilde olacaktır.

(d)     Bu kuralların amacının gerçekleşmesi için Teşkilat tarafından trafik ayırım düzenleri benimsenebilir.

(e)     Özel bir şekilde veya özel bir amaç için inşa edilmiş olan bir teknenin fenerlerinin sayısı, yeri, kapasitesi veya görünüş açıları veya şekilleri ile  sesli işaret aletlerinin yeri veya nitelikleri bakımından bu kuralların hükümlerine uymadığının ilgili hükümetçe saptanmış olması halinde, teknenin özel faaliyetine müdahale etmeden, böyle bir teknenin fenerlerinin sayısı, yeri, kapasitesi, görünüş mesafe veya açıları ile sesli işaret aletlerinin yerleri ve nitelikleri bakımından o tekne için Hükümeti bu Kurallara mümkün olduğu kadar yakın olanını saptayacaktır.


KURAL: 2
Sorumluluk

(a)     Bu kurallardaki hükümlerden hiçbiri, herhangi bir tekneyi veya sahibini, Kaptanı veya gemi adamlarını, bu Kurallara uyma veya gemicilerin her zamanki görevlerinin veya özel durum ve koşullarının gerektirdiği herhangi bir tedbirin  alınması hususundaki ihmallerinin sonuçlarından kurtaramaz.
(1) 4-20 Ekim 1972 tarihleri arasında Londra'da düzenlenen Konferansta kabul edilen 1972 Uluslararası Denizde Çatışmayı önleme Sözleşmesinin uygulanmasıyla ilgili Denizde Çatışmayı Önleme Tüzüğü, Dışişleri Bakanlığının     19.8.1977 tarih ve ÇSUD: 1128 sayılı yazısı üzerine, 31.5.1963 tarihli    ve 244 sayılı Kanunun 3 üncü ve 5 inci maddelerine göre, Bakanlar Kurulunca 12.12.1977 tarihinde onaylanmıştır.

(b)     Bu kuralları yorumlarken ve uygularken ilgili teknelerin sınırlı oluşları hususu da dahil, ani bir tehlikeden kaçınırken bu kuralların hükümlerinden ayrılmayı gerektirebilecek olan hususlar dahil seyir ve çatışmanın ve herhangi bir özel şartın tüm tehlikeleri gözönünde tutulacaktır.

 KURAL: 3
Genel Tanımlamalar

Bu Metin içinde aksine bir hüküm bulunmadıkça, bu Kuralların amacı için:

(a)     "Tekne" sözcüğü: Su üstünde kalkarak seyreden ve deniz uçakları dahil, su üzerinde taşıma aracı olarak kullanılmakta olan veya kullanılmaya elverişli bulunan hertürlü deniz aracını içine alır.

(b)     "Kuvvetle yürütülen tekne" deyimi: Makine ile yürütülen herhangi bir  tekne anlamına gelecektir.

(c)     "Yelkenli tekne" deyimi: Var olsa bile yürüten makinesinin kullanılması şartıyla, yelken ile seyreden bir tekne anlamına gelecektir.

(d)     "Balıkçılık yapan tekne" deyimi: Manevra kabiliyetini sınırlayan, ağlar, oltalar, troller veya diğer avlanma araçları ile balık avlayan bir tekne anlamına gelecek fakat manevra kabiliyetini kısıtlamayacak olan oltalar veya diğer avlanma araçları ile balık avlayan bir tekneyi kapsamıyacaktır.

(e)     "Deniz uçağı" sözcüğü: Su üstünde manevra yapmak üzere inşa edilmiş hertürlü hava aracını kapsar.

(f)      "Kumanda altında bulunmayan tekne" deyimi: Bazı istisnai şartlar sebebi ile bu kuralların gereğine uygun olarak manevra yapma gücü olmayan ve bu yüzden diğer bir teknenin yolundan çıkma yeteneği bulunmayan bir tekne anlamına gelecektir.

(g)     (Değişik: 20.9.1984 - 84/8541 K.) "Manevra kabiliyeti sınırlı tekne" deyimi: Yaptığı iş nedeniyle bu Kuralların gereğince uygun olarak manevra yapma gücü sınırlanan ve bu yüzden diğer bir teknenin yolundan çıkma yeteneği olmayan bir tekne anlamına gelecektir.

         "Manevra kabiliyeti sınırlı tekneler" deyimi sınırlı olmamak üzere aşağıda  yazılı tekneleri içerecektir.

(i)      Bir seyir işareti, denizaltı kablosu veya boru hattının döşenmesi, çalışması veya toplanmasında bulunan bir tekne,

(ii)      Tarama, sörvey veya sualtı çalışmaları yapan bir tekne,

(iii)     Üzerinde yol bulunduğu halde ikmal yapan veya insan, kumanya veya yük aktaran bir tekne,

(iv)     Bir hava aracını denize indirme veya denizden alma işi ile uğraşan bir tekne,

(v)      Mayın temizleme işleri yapan bir tekne,

(vi)     Gerek yedekleyen ve gerekse yedeklenenin rotalarından ayrılma yetenekleri önemli bir şekilde kısıtlanan yedekleme işiyle uğraşan bir tekne.

(h)     "Su çekimi nedeniyle kısıtlı tekne" deyimi: Mevcut su derinliğinin kendi çektiği su ile ilişkisi nedeniyle izlediği rotadan ayrılma gücü önemli bir şekilde kısıtlanan, kuvvetle yürütülen bir tekne anlamına gelecektir.

(i)      "Üzerinde yol bulunan" deyimi: Bir teknenin demirli olmadığı veya karayabağlı bulunmadığı veya karaya oturmadığı anlamına gelecektir.

(j)      Bir teknenin "boyu" ve "eni" sözcükleri: O teknenin tam boyu ve en geniş eni anlamlarına gelecektir.

(k)     Teknelerden birinin diğeri tarafından gözle görülmesi halinde, teknelerin birbirlerini gördükleri varsayılacaktır.

(l)      "Kısıtlı görüş" deyimi: Görüşün sis, pus, kar yağışı, şiddetli yağmur  fırtınası, kum fırtınası veya herhangi diğer benzeri bir sebeple kısıtlı oluşu  anlamına gelecektir.

BÖLÜM B - MANEVRA VE SEYİR KURALLARI

KISIM 1 - HERTÜRLÜ GÖRÜŞ KOŞULLARINDA TEKNELERİN YÖNETİMİ

KURAL: 4
Uygulama

Bu kısımdaki Kurallar hertürlü görüş koşulunda uygulanır

KURAL: 5
Gözcülük

İçinde bulunulan durum ve koşullarda, durumun ve çatışma tehlikesinin tamamen değerlendirilmesini sağlamak üzere, elde mevcut tüm uygun araçların yanısıra her tekne her zaman tam bir görme ve işitme gözcülüğü de yapacaktır.

KURAL: 6
Emniyetli Hız

Çatışmayı önlemek üzere, uygun ve etkili harekete geçebilmek ve içinde bulunulan durum ve koşulların gerektirdiği bir mesafede durdurulabilmesi için, her  tekne her zaman emniyetli bir hızla ilerleyecektir.
Emniyetli hız saptanırken aşağıda yazılı faktörler dikkate alınacaktır.

(a)     Tüm tekneler tarafından,

(i)      Görüş durumu,

(ii)      Balıkçı tekneleri veya diğer teknelerin bir araya toplanmış durumu dahil trafik yoğunluğu,

(iii)     Teknenin durdurulma mesafesine ve içinde bulunduğu koşullarda dönme   kabiliyetine özel surette dikkat edilerek teknenin manevra yapabilme yeteneği, 

(iv)     Sahil ışıkları ve kendi ışıklarının geceleyin geriye doğru yayılması  gibi arka cephe ışıklarının varlığı,

(v)      Rüzgar, deniz ve akıntının durumu ve seyir tehlikelerinin yakınlığı,

(vi)     O yerde var olan su derinliği ile tekne su çekiminin ilişkisi,

(b)     Çalışır radarı olan tekneler için ek olarak:

(i)      Radar cihazının karakteri, yeterlilik ve sınırlılığı,

(ii)      Kullanılmakta olan radar mesafe ayarının zorunlu kıldığı kısıtlamalar,

(iii)     Denizin durumu, hava ve diğer müdahale kaynaklarının radar, alıcılığı üzerindeki etkisi,

(iv)     Küçük tekneler buz ve diğer yüzer maddelerin yeterli bir radar mesafesinde, radar tarafından alınamaması durumu,

(v)      Radarda görülen teknelerin sayısı, bulundukları yer ve hareketleri,

(vi)     Yakın çevrede bulunan tekneler ve diğer maddelerin radar kullanılarak mesafesi saptanırken görüşün daha kesin olarak saptanmasına olanak bulunacağı.

KURAL: 7
Çatışma Tehlikesi

(a)     Her tekne çatışma tehlikesi olup olmadığını saptamak için içinde bulunduğu durum ve koşullara uygun olan elde mevcut araçların tümünü kullanacaktır.Herhangi bir tereddüt mevcut olduğu takdirde, böyle bir tehlike varsayılacaktır.

(b)     Radar varsa ve çalışıyorsa, çatışma tehlikesini önceden saptamak ve radarla ardarda mevki koymak veya buna benzer radar ekranında görülen cisimlerin usulüne uygun gözlemlerini yapmak üzere uzak mesafe taramalar da dahil radar cihazından gerekli şekilde faydalanılacaktır. oturtulmayacaktır.

(d)     Çatışma tehlikesinin mevcut olup olmadığı saptanırken aşağıda yazılı hususlar dikkate alınacaktır:

(i)      Yaklaşan bir teknenin pusula kerterizinin farkedilir derecede değişmemesi halinde tehlike var sayılacaktır.

(ii)      Özellikle çok büyük bir tekneye veya yedek çekene veya yakın mesafede olan bir tekneye yaklaşırken farkedilir derecede kerteriz değişmesi görüldüğü  durumlarda da çatışma tehlikesi bazen mevcut olabilir.

KURAL: 8
Çatışmayı Önleme Hareketi

(a)     Olayın koşulları elverişli olduğu ve iyi gemicilik kurallarına uyularak yeterli bir süre içinde yapıldığı takdirde çatışmayı önlemek için girişilecek  herhangi bir hareket olumlu olacaktır.

(b)     Olayın koşulları elverişli olduğu takdirde çatışmayı önlemek üzere yapılacak her rota ve/veya hız değişimi gözle veya radarla diğer bir teknenin çabucak görebileceği kadar büyük olacak ve birbiri ardından yapılacak küçük rota ve/veya hız değişimlerinden kaçınılacaktır.

(c)     Eğer manevra sahası varsa, yakın düşme durumundan sakınmak için sadece  zamanında yapılmış rota değişikliği, oldukça önemli ve diğer yakın düşmelere sebep olmayan en etkili bir hareket olabilir.

(d)     Diğer bir tekne ile çatışmayı önlemek üzere girişilecek hareket, bu teknenin emniyetli bir mesafeden geçmesi ile sonuçlanacak harekettir. Hareketin etkili olup olmadığı diğer tekne tam olarak geçilinceye ve neta oluncaya kadardikkatle kontrol edilecektir.

(e)     Çatışmayı önlemek veya durumu değerlendirmek için biraz daha zaman kazanmak üzere, bir tekne gerekiyorsa yürütücü kuvvetlerini durdurarak veya geri çalıştırarak hızını azaltacak veya ilerleyişini durduracaktır.

KURAL: 9
Dar Kanallar

(a)     Dar bir kanal veya geçit boyunca ilerleyen bir tekne geçit veya kanalın emin ve uygulayabildiği kadar, kendi sancak tarafındaki dış sınırına yakın seyredecektir.

(b)     Boyu 20 metreden az olan bir tekne veya yelkenli bir tekne dar bir kanal veya geçitte emniyetle seyreden bir teknenin geçisine engel olmayacaktır.

(c)     Balıkçılıkla uğraşan bir tekne dar bir kanal veya geçitte seyreden bir teknenin geçişine engel olmayacaktır.

(d)     Bir dar kanal veya geçitte karşıdan karşıya geçen bir tekne, sadece böyle bir kanalın veya geçidin içinde emniyetle seyredebilecek bir teknenin geçişine engel olacaksa, bu geçişi yapmayacaktır. Karşıdan karşıya geçen teknenin niyetinden şüphe eden bir tekne Kural 34 (d) de belirlenen ses işaretini kullanabilir.

(e)(i)      Dar bir kanal veya geçitte, yetişen gemi, yetişilen gemiyi geçme niyetini 34 (c) (i) sayılı Kuralda belirtilen uygun ses işaretini vererek gösterirse yetişilen gemi emniyetle geçişe izin veren tedbirleri alırsa ancak o zaman geçiş yapılabilir. Mutabakata varıldığı takdirde, yetişilen gemi 34 (c) (ii) sayılı Kuralda belirtilen uygun ses işaretini verecek, emniyetli geçişe izin vermek üzere harekete geçecektir. Şüpheli durumda, yetişilen gemi 34 (d) sayılı Kuralda belirtilen ses  işaretini verebilir.

(ii)      Bu kural yetişen teknenin 13. üncü Kuralda belirtilen yükümlülüğünü ortadan kaldırmaz.

(f)      Araya giren bir engel sebebiyle diğer teknelerin görülmesinin engellendiği dar bir kanal veya bir geçitin bir dönüm yerine veya bir alanına yaklaşan bir tekne özel tedbir ve dikkatle seyredecek, 34 (e) sayılı kuralda belirtilen  uygun ses işaretini verecektir.

(g)     Olayın koşulları elverdiği takdirde, hiçbir tekne dar bir kanalda demirlemeyecektir.

KURAL: 10
Trafik Ayırım Düzenleri

(a)     Bu kural Teşkilatın kabul ettiği trafik ayırım düzenlerine uygulanacaktır.

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Trafik ayırım düzenlerini kullanan bir tekne:

(i)      Uygun trafik şeridinde, o şeridin genel trafik akımı yönünde ilerleyecektir.

(ii)      Uygulanabildiği kadar trafik ayırım hattı veya ayırım bölgesinden açık bulunacaktır.

(iii)     Normal olarak, şeridin bitiminde trafik şeridine girecek veya çıkacaktır. Fakat her iki taraftan girer veya çıkarken genel trafik akım yönüne, uygulanabildiği kadar, küçük bir açı ile girip çıkacaktır.

(c)     Bir tekne mümkün olduğu kadar, trafik şeritlerinde karşıdan karşıya geçmekten kaçınacaktır. Fakat böyle bir geçiş zorunluluğunda olduğu zaman, geçişi  uygulayabileceği kadar genel trafik akımı yönüne dik açıya en yakın bir açı ile yapacaktır.

(d)     (Değişik: 20.9.1984 - 84/8541 K.) Bitişik ayırım düzenindeki uygun trafik şeridini emniyetle kullanabilecek olan, akan trafik, normal olarak kıyıya  yakın trafik bölgelerini kullanmayacaktır. Ancak boyu 20 metreden küçük tekneler veya yelkenli tekneler her türlü koşullar altında kıyı tarafındaki trafik bölgelerini kullanacaklardır.

(e)     (Değişik: 20.9.1984 - 84/8541 K.) Aşağıdaki durumlar hariç olmak üzere karşıdan karşıya geçen bir tekne yada bir trafik şeridine giren ya da çıkan tekne dışında bir tekne, normal olarak ayırım bölgesine girmeyecek ve ayırım hattını geçmeyecektir.

(i)      Acil durumlarda, ani bir tehlikeden kaçınma durumunda,

(ii)      Bir ayırım bölgesi içinde balıkçılıkla uğraşıldığında,

(f)      Trafik ayırım düzeni sonlarına yakın alanlarda seyreden bir tekne özel bir dikkat gösterecektir.

(g)     Bir tekne bir trafik ayırım düzeni içinde veya bu düzenin sonlarına yakın alanlarda demirlemekten mümkün olduğu kadar kaçınacaktır.

(h)     Bir trafik ayırım düzenini kullanmayan bir tekne mümkün olduğu kadar, uzak geçerek bu düzenden kaçınacaktır.

(i)      Balıkçılıkla uğraşan bir tekne bir trafik şeridini takibeden herhangi bir teknenin geçisini engellemeyecektir.

(j)      Boyu 20 metreden az olan bir tekne veya yelkenli bir tekne bir trafik şeridini takibeden herhangi bir kuvvetle yürütülen teknenin emniyetle geçişini  engellemeyecektir.

(k)     (Ek: 20.9.1984 - 84/8541 K.) Manevra kabiliyeti sınırlı bir tekne bir trafik ayırma düzeni içinde seyir güvenliği için bakım tutum işleri yapıyorsa  işin süresince bu Kuralı uygulamak zorunda olmayacaktır.

(l)      (Ek: 20.9.1984 - 84/8541 K.) Manevra kabiliyeti sınırlı bir tekne bir trafik ayırma düzeni içinde denizaltı kablosu döşeme, hizmet verme ya da kaldırma işinde çalıştığı zaman, işin süresince, bu Kuralı uyğulamak zorunda olmayacaktır.

KISIM II - BİRBİRİNİ GÖREN TEKNELERİN DAVRANIŞLARI

KURAL: 11
Uygulama
         Bu kısımda mevcut kurallar birbirini gören tekneler için uygulanır.

KURAL: 12
Yelkenli Tekneler

(a)     Çatışma tehlikesi mevcut olacak şekilde iki yelkenli birbirine yaklaşırken bu teknelerden biri aşağıda yazılı olan şekilde diğerinin yolundan çıkacaktır.

(i)      Rüzgarı farklı bordalardan kullanan teknelerden rüzgarı iskeleden kullanan tekne diğerinin yolundan çıkacaktır.

(ii)      Her iki tekne de rüzgarı aynı taraftan kullanıyorsa rüzgar üstünde olan tekne rüzgar altında olan teknenin yolundan çıkacaktır.

(iii)     Rüzgarı iskeleden kullanan bir tekne rüzgar üzerinde bir tekne görür ve bu gördüğü teknenin rüzgarı iskele tarafından mı yahut sancak tarafından mı kullandığını saptayamazsa gördüğü diğer teknenin yolundan çıkacaktır.

(b)     Bu kuralın amaçları için, ana yelkenin şiştiği taraf veya seren yelkenli bir teknede baştan kıça doğru olan en büyük yan yelkenin şiştiği tarafın aksi tarafı rüzgar üstü sayılacaktır.

KURAL: 13
Yetişme

(a)     (Değişik: 20.9.1984 - 84/8541 K.) Bir tekneye yetişen diğer herhangi bir tekne bu Kuralların, Bölüm B. Kısım I ve Kısım II deki mevcut hükümlerine bakılmaksızın yetişilen teknenin yolundan çıkacaktır.

(b)     Herhangi bir tekneye, kemeresinin 22.5 derece (2 kerte) den daha fazla  gerisindeki herhangi bir yönden yaklaşan bir tekne, yani yetişmekte olduğu tekneye göre, geceleyin o teknenin sadece pupa fenerini görüp borda fenerlerinden  hiçbirini göremiyecek mevkide bulunan tekne "yetişen bir tekne" sayılacaktır.

(c)     Bir tekne diğer bir tekneyi yetişip geçtiği hususunda herhangi bir tereddüde düştüğü takdirde, kendini yetişen tekne sayarak buna göre hareket edecektir.

(d)     İki tekne arasındaki kerterizlerde sonraki herhangi bir değişim, yetişen tekneyi bu Kurallara göre, aykırı geçen bir tekne yapmayacak veya yetişilen tekne tam olarak geçilinceye ve neta oluncaya kadar, yetişen teknenin yükümlülüğünü kaldırmayacaktır.

KURAL: 14
Pruva Pruvaya Geliş Durumu

(a)     Kuvvetle yürütülen iki teknenin, çatışma tehlikesi söz konusu edilecek  surette, birbirlerine karşı veya karşıya yakın birer rota ile yaklaşmaları halinde, bu teknelerden herbiri diğerinin iskelesinden geçmek üzere, rotasını sancağa değiştirecektir.

(b)     Bir teknenin diğerini pruvasında veya pruvasına yakın ve gece silyon fenerlerini bir doğru üzerinde veya doğruya yakın bir halde ve/veya her iki borda fenerini birlikte gördüğü, gündüz ise, diğer tekneyi buna benzer bir durumda gördüğü zaman, yukardaki durumun mevcut olduğu varsayılacaktır.

(c)     Böyle bir durumun varlığından tereddüte düşen bir tekne bu durumun hakikaten mevcut olduğunu varsayacak ve buna uygun olarak hareket edecektir.

KURAL: 15
Aykırı Geçiş

Kuvvetle yürütülen iki teknenin çatışma tehlikesi doğuracak şekilde birbirini aykırı olarak geçmeleri halinde, diğer tekneyi sancak tarafından gören tekne onun yolundan çıkacak koşullar elverdiği takdirde diğerinin pruvasından geçmekten kaçınacaktır.

KURAL: 16
Yol Veren Teknenin Davranışı

Diğer bir tekneye yol vermekle yükümlü olan tekne iyice neta olmak üzere, olanağı kadar erken ve belirgin manevra yapacaktır.

KURAL: 17
Yol Verilen Teknenin Davranışı

(a)

(i)      İki tekneden biri diğerinin yolundan çıkmak zorunluluğunda bulunduğu yerlerde diğeri kendi rotasını ve hızını koruyacaktır.

(ii)      Bu kurallar uyarınca yol vermesi gereken teknenin uygun manevra yapmadığı görülür görülmez, manevra yapmakla yükümlü olmayan tekne çatışmayı sadece kendi manevrası ile önlemek üzere harekete geçebilir.

(b)

(ii)      Rotasını ve hızını muhafaza etmesi gereken tekne, herhangi bir sebepten dolayı, sadece yol vermesi gereken teknenin yapacağı manevra ile çatışmanın önüne geçilemiyecek kadar kendisini yakın bulursa, çatışmayı önlemeye yardımcı olacak en iyi hareketi yapacaktır.

(c)     Bir aykırı geçiş durumunda, diğer kuvvetle yürütülen bir tekne ile çatışmayı önlemek üzere, bu Kuralın (a) (ii) sayılı alt paragrafı uyarınca manevra yapan kuvvetle yürütülen bir tekne, olayın koşulları elverdiği takdirde, kendi iskele tarafından gördüğü bir tekne için rotasını iskelesine alarak değiştirmeyecektir.

(d)     Bu kural,yol vermesi gereken teknenin yol verme yükümlülüğünü kaldırmaz.

KURAL: 18
Tekneler Arasındaki Sorumluluklar

9, 10 ve 13 sayılı Kuralların aykırı hükümleri hariç:

(a)     Üzerinde yol bulunan Kuvvetle yürütülen bir tekne

(i)      Kumanda altında bulunmayan,

(ii)      Manevra yapma gücü kısıtlı olan,

(iii)     Balıkçılıkla uğraşan,

(iv)     Yelkenli        bir teknenin yolundan çıkacaktır.

(b)     Üzerinde yol bulunan bir yelkenli tekne,

 (i)     Kumanda altında bulunmayan,

(ii)      Manevra yapma gücü kısıtlı olan,

(iii)     Balıkçılıkla uğraşan, diğer bir teknenin yolundan çıkacaktır.

(c)     Üzerinde yol bulunan balıkçılıkla uğraşan bir tekne olanağı kadar:

(i)      Kumanda altında bulunmayan,

(ii)      Manevra yapma gücü kısıtlı olan,  bir teknenin yolundan çıkacaktır.

(d)    

(i)      Kumanda altında olmayan veya manevra yapma gücü kısıtlı olan birteknenin dışında hiçbir tekne, içinde bulunduğu koşulların elvermesi halinde, kendi su çekimi nedeniyle kısıtlı olan ve 28 nci kuraldaki işareti gösteren bir teknenin emniyetle geçisine engel olmayacaktır.

(ii)      Kendi su çekimi nedeniyle kısıtlı olan bir tekne özel durumunu gözönünde tutarak dikkatle seyredecektir.

(e)     Su üzerinde bulunan bir deniz uçağı, genellikle, bütün teknelerden tamamen neta bir halde bulunacak ve bunların seyrini engellemekten kaçınacaktır. Çatışma tehlikesinin var olduğu koşullarda bu bölümdeki kurallara uyacaktır.

KISIM III - KISITLI GÖRÜŞ KOŞULLARINDA TEKNELERİN DAVRANIŞLARI

KURAL: 19
Kısıtlı Görüş Koşullarında Teknelerin Davranışları

(a)     Bu kural, görüş şartları kısıtlı olan bir alanda veya böyle bir alana yakın yerlerde seyrederken birbirini görmeyen teknelere uygulanacaktır.

(b)     Her tekne, kısıtlı görüşün içinde bulunan durum ve koşullarına göre ayarlanacak olan emniyetli bir hızla ilerleyecektir. Kuvvetle yürütülen bir tekne, ani manevralar için makinelerini hazır bulunduracaktır.

(c)     Her tekne bu Bölümün 1 inci Kısmındaki Kuralları uygularken, kısıtlı görüşün içinde bulunalan durum ve koşullarını dikkate alacaktır.

(d)     Sadece radarla diğer bir teknenin varlığını anlayan bir tekne bir çatışma alanına girme halinin oluşup oluşmadığını ve/veya çatışma tehlikesinin bulunmadığını saptayacaktır. Böyle bir durumun mevcut olması halinde önleyici manevrayı zamanında yapacak, ancak, bu manevra bir rota değiştirilmesini gerektiriyorsa aşağıdaki hususlardan olanağı ölçüsünde kaçınılacaktır.

(i)      Yetişilen bir tekne hariç, kemere doğrultusunun ilersinde bulunan bir tekne için rotanın iskeleye alınması,

(ii)      Rotanın kemere doğrultusunda veya kemere doğrultusunun gerisinde olan bir tekneye doğru değiştirilmesi,

(e)     Çatışma tehlikesinin var olmadığının saptandığı haller hariç, kendi kemere doğrultusunun ön tarafında başka bir teknenin sis işaretini duyan veya kemere doğrultusu önünde bulunan bir tekne ile yakın düşme durumlarından kaçınamıyan bir tekne hızını rotasını koruyabileceği alt düzeye indirecektir. Böyle bir tekne çatışma tehlikesi geçinceye kadar üzerindeki bütün yolu kesecek ve her durumda çok dikkatle seyir edecektir.

C - FENERLER VE ŞEKİLLER:

KURAL: 20
Uygulama

(a)     Bu bölümdeki kurallara, bütün hava koşullarında uyulacaktır.

(b)     Fenerlere ait Kurallar güneşin batışından doğuşuna kadar uygulanacak ve bu süre içerisinde Kurallarda belirlenen fenerlerle karıştırılmayacak veya bunların görüşlerini veya ayırıcı karakterlerini bozmayacak veya iyi bir gözcülük yapılmasını engellemeyecek olan fenerler dışında diğer hiçbir ışık gösterilmeyecektir.

(c)     Bu kurallarda belirtilen fenerler, taşındığı takdirde, kısıtlı görüşlerde güneşin doğuşundan batışına kadar da, gösterilecek ve gerekli görülen diğer bütün koşullarda da gösterilebileceklerdir.

(d)     Şekillerle ilgili kurallar gündüzleri uygulanacaktır.

(e)     Bu kurallarda belirlenen fenerler ve şekiller bu kuralların 1 sayılı Lahikasının hükümlerine uygun olacaktır.

KURAL: 21
Tanımlamalar

(a)     "Silyon feneri" deyimi: Teknenin baş-kıç orta hattı üzerine konulan 225 derecelik bir ufuk yayı üzerinde kesiksiz bir ışık gösteren ve teknenin her iki tarafında tam pruvadan itibaren kemerenin 22,5 derece gerisine kadar ışık gösterecek surette yerleştirilmiş beyaz bir fener anlamına gelecektir.

(b)     "Borda fenerleri" deyimi: Herbiri 112,5 derecelik bir ufuk yayı üzerinde tam pruvadan kendi tarafındaki kemerenin 22,5 derece gerisine kadar kesiksiz bir ışık gösterecek surette yerleştirilmiş sancak tarafında, yeşil, iskele tarafında kırmızı fener anlamına gelecektir. Boyu 20 metreden kısa teknelerde,borda fenerleri teknenin baş-kıç orta hattı üzerinde bulunan bir fanus içinde birleşik olarak taşınabilir.

(c)     "Pupa feneri" deyimi: Olanağı kadar teknenin kıç tarafına yakın bir yere konulan, ufkun 135 derecelik bir yayı üzerinde kesiksiz beyaz bir ışık gösteren, tam kıçtan itibaren geminin her iki bordasında 67,5 derecelik bir ışık göstermek üzere yerleştirilmiş beyaz ışık veren bir fener anlamına gelecektir.

(d)     "Yedekleme feneri" deyimi: Bu kuralın (c) paragrafında belirlenen "Pupa  feneri" ile aynı nitelikte olan sarı ışık veren bir fener anlamına gelecektir. 

(e)     "Her taraftan görülür fener" deyimi: Ufkun 360 derecelik yayı üzerinde  kesiksiz ışık gösteren bir fener anlamına gelecektir.

(f)      "Çakar fener" deyimi: Düzenli aralıklarla dakika 120 veya daha fazla çakan bir fener anlamına gelecektir.

KURAL: 22
Fenerlerin Görünüşü

Bu kurallarda belirtilen fenerler, en az aşağıda yazılı mesafelerden görünebilmeleri için, bu Kuralların 1 inci lahikasının 8 inci kısmında belirlenen şiddette olacaklardır.

(a) Boyları 50 metre veya daha fazla olan tekneler:

- 6 milden

- 6 milden görünür silyon feneri,

- 3 milden görünür borda feneri,

- 3 milden görünür pupa feneri,

- 3 milden görünür yedekleme feneri,

- 3 milden ve her yönden görünür beyaz, kırmızı, yeşil veya sarı fener

(b) Boyları 12 metre veya daha fazla olan fakat 50 metreden az olan tekneler

- 2 milden görünür silyon feneri ancak boyu 20 metreden az olan teknelerde 3

milden görünür olacaktır.

- 2 milden görünür borda feneri,

- 2 milden görünür pupa feneri,

- 2 milden görünür yedekleme feneri,

- 2 milden ve her yönden görünür beyaz, kırmızı, yeşil veya sarı fener.

 (c) Boyu 12 metreden az olan tekneler

- 2 milden görünür silyon feneri,

- 1 milden görünür borda feneri,

- 2 milden görünür pupa feneri,

- 2 milden görünür yedekleme feneri,

- 2 milden ve her yönden görünür, beyaz, kırmızı, yeşil veya sarı fener.

 (d)  (Ek: 20.9.1984 - 84/8541 K.) Kolay görülemeyen, kısmen batık tekneler ya da cisimler yedeklendiğinde:

- 3 milden her yönden görünür beyaz bir fener.

KURAL: 23
Üzerinde yol bulunan Kuvvetle Yürütülen Tekneler

(a)     Kuvvetle yürütülen bir tekne üzerinde yol olduğu zaman:

(i)      Baş tarafta bir silyon feneri,

(ii)      Boyları 50 metreden daha kısa olan bir teknenin gösterme yükümlülüğü ulunmaması hali hariç, kıç tarafa doğru ve baş taraftakinin yukarısında ikinci bir silyon feneri,

(iii)     Borda fenerleri,

(iv)     Bir pupa feneri.

(b)     Bir hava-yastıklı tekne su üzerinde kalkarak çalıştığı zaman, bu kuralın (a) paragrafında belirtilen fenerlere ek olarak, ufkun her tarafından görülen, sarı renkte çakar bir fener taşıyacaktır

(c)     (Değişik: 20.9.1984 - 84/8541 K.)

(i)      Boyu 12 metreden küçük olan kuvvetle yürütülen bir tekne bu Kuralın (a) paragrafında belirtilen fenerler yerine her yönden görünür bir beyaz fener ve borda fenerleri gösterebilir.

(ii)      Azami hızı 7 deniz milini geçmeyen, boyu 7 metreden küçük kuvvetle yürütülen bir tekne bu Kuralın (a) paragrafında belirtilen fenerlerin yerine her yönden görünür bir beyaz fener ve uygulanabildiği takdirde aynı zamanda borda fenerlerini de gösterebilir.

(iii)     Boyu 12 metreden küçük olan ve kuvvetle yürütülen bir teknede silyon  fenerinin ya da her yönden görünür beyaz bir fenerin baş-kıç doğrultusu üzerinde gösterilmesi, bu doğrultu üzerinde fener donatılmasının pratik bulunmaması dolayısiyle sağlanamadığı takdirde bu fenerler orta hat dışında gösterilebilir. Ancak, bu takdirde borda fenerleri kombine olarak bir fener halinde ve baş-kıç  orta doğrultusu üzerinde, ya da silyon, yahut her yönden görünür beyaz fenerle mümkün olduğu kadar ayni baş-kıç doğrultusunda gösterilecektir.

KURAL: 24
Çekerek ve iterek yedekleme

(a)     (Değişik: 20.9.1984 - 84/8541 K.) Kuvvetle yürütülen bir tekne yedeklerken:

(i)      Kural 23 (a) (i) ya da (a) (ii) de belertilen fener yerine dikey bir  doğru üzerinde,iki silyon feneri gösterecektir. Yedekleyen bir teknenin kıçından yedeklenenin kıç sonuna kadar olan mesafenin 200 metreden fazla olması halinde  dikey bir doğru üzerinde üç adet adı geçen fenerleri gösterecektir.

(ii)      Borda feneri;

(iii)     Bir pupa feneri;

(iv)     Pupa feneri üzerinde, dikey bir doğru üzerinde bir yedekleme feneri;

(v)      Yedek boyu 200 metreden fazla olduğu zaman, en iyi görülebilecek bir yerinde eşkenar dörtgen (mayın) şekli, gösterecektir.

(b)     İten tekne ile ileri itilen tekne birleşik tek bir tekne gibi birbirlerine sıkıca bağlı iseler, bunlara, kuvvetle yürütülen bir tekne gözüyle bakılacak ve bu tekneler 23 üncü kuralda belirtilen fenerleri göstereceklerdir.

(c)     (Değişik: 20.9.1984 - 84/8541 K.) Birleşik tek bir tekne hali hariç, kuvvetle yürütülen bir tekne diğer bir tekneyi ileri itiyor veya bordasında yedekliyorsa;

(i)      Kural 23 (a) (i)'de belirtilen fenerin yerine baş tarafta dikey bir doğru üzerinde iki silyon fenerini;

(ii)      Borda fenerlerini;

(iii)     Bir pupa fenerini;    gösterecektir.

(d)     (Değişik: 20.9.1984 - 84/8541 K.) Bu Kuralın (a) ya da (c) paragraflarının uygulanacağı kuvvetle yürütülen bir tekne,aynı zamanda Kural 23 (a) (ii)'nin hükümlerini de uygulayacaktır.

(e)     (Değişik: 20.9.1984 - 84/8541 K.) Bu Kuralın (g) paragrafında belirtilenin dışında yedeklenen bir tekne ya da cisim:

(i)      Borda fenerlerini;

(ii)      Bir pupa fenerini;

(iii)     Yedek boyunun 200 metreden fazla olması halinde, en iyi görülebilecek yerinde bir eşkenar dörtgen şekli gösterecektir.

(f)      Sayıları belirsiz tekneler: Bir grup halinde, bordada yedeklendiği veya itildiği zaman tek bir tekne gibi fener göstereceklerdir.

(i)      Birleşik bir birimin parçası olmadığı zaman ileri itilerek, yürütülen  bir tekne başucunda borda fenerlerini gösterecektir.

(ii)      Diğer bir teknenin bordasında yedeklenen bir tekne pupa fenerini ve  başucunda borda fenerlerini gösterecektir.

(g)     (Değişik: 20.9.1984 - 84/8541 K.) Kolay görülemiyen, kısmen batık tekne veya cisim ya da gurup halinde böyle tekneler ya da cisimler yedeklendiğinde  bunlar:

(i)      Eğer genişlik 25 metreden az ise başta ya da başa yakın bir yerde her  yönden görünür bir beyaz fener ve kıçında ya da kıçına yakın bir yerde her yönden görünen bir beyaz fener gösterecek, ancak drakonlar pruvada ya da pruvaya yakın bir yerde böyle bir fener göstermek zorunda olmayacaklardır.

(ii)      Eğer genişlik 25 metre ya da daha fazla ise, bu durumda, genişliğin en uç noktalarında ya da yakın bir yerde her yönden görünür iki ilave beyaz fener  gösterilecektir.

(iii)     Eğer uzunluk 100 metreden fazla ise (i) ve (ii) alt paragraflarda belirtilen fenerlere ilaveten aralarındaki mesafe 100 metreyi geçmemek üzere her  yönden görünür beyaz fenerler konulacaktır.

(iv)     Yedeklenen son tekne ya da cismin en kıçında ya da yakınında bir eşkenar dörtgen cismi gösterilecek ve yedekleme uzunluğu 200 metreyi geçiyorsa ilaveten bir eşkenar dörtgen şekli, baş tarafta uygulanabildiği kadar en iyi görülen bir yerde gösterilecektir.

(h)     (Ek: 20.9.1984 - 84/8541 K.) Yedekte çekilen bir tekne ya da cismin yeterli herhangi bir sebeple bu Kuralın (e) ya da (g) paragraflarında belirtilen  fenerleri ya da şekilleri göstermesinin pratik olmayacağı yerlerde yedekte çekilen teknenin veya cismin aydınlatılması veya böyle bir tekne veya cismin varlığının gösterilmesi için olanağı bulunan, tüm tedbirler alınacaktır.

(i)      (Ek: 20.9.1984 - 84/8541 K.) Normal olmayan bir yedekleme işinde bulunan bir tekne için yeterli herhangi bir sebeple bu Kuralın (a) ve (c) paragraflarında belirtilen fenerlerin gösterilmesinin pratik olmayacağı yerlerde böyle bir  tekne tehlike içinde bulunan ya da başka bir şekilde yardım isteyen gemiyi yedeklediğinde bu fenerleri göstermek zorunda olmayacaktır. Kural 36'da istenildiği üzere yedekleyen tekne ile yedeklenen tekne arasındaki ilişkiyı belirtmek, özellikle yedekleme halatını aydınlatmak üzere, olanaklar elverdiğince tüm önlemler alınacaktır.

KURAL: 25
Üzerinde Yol Bulunan Yelkenli Tekneler ve Kürekli Tekneler

(a)     Üzerinde yol bulunan bir yelkenli tekne:

(i)      Borda fenerlerini,

(ii)      Bir pupa fenerini, gösterecektir.

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Boyu 20 metreden kısa olan bir yelkenli teknede bu Kuralın (a) paragrafında belirtilen fenerler, en iyi görülebilecekleri yer olan direk başı veya direk başına yakın bir yerde taşınacak olan bir fanus içinde birleşik bir halde bulunabilirler.

(c)     Üzerinde yol bulunan bir yelkenli tekne bu kuralın (a) paragrafında belirtilen fenerlere ek olarak, en iyi görülebilecekleri yer olan direk başı veya direk başına yakın bir yerde dikey bir doğru üzerinde ufkun her tarafından görülür üstteki kırmızı alttaki yeşil olan iki fener taşıyabilirler. Ancak, bu fenerler, bu Kuralın (b) paragrafında müsaade edilen birleşik fanusla bir arada gösterilmeyecektir.

(d)

(i)      Boyu 7 metreden kısa olan bir yelkenli tekne uygulayabildiği takdirde bu kuralın (a) veya (b) paragrafında belirtilen fenerleri gösterecektir,fakat gösteremezse çatışmayı önleyecek kadar yeterli bir sürede gösterilmek üzere bir  elektrikli cep fenerini veya beyaz bir ışık gösteren ve yanık halde bulunan bir feneri el altında hazır bulunduracaktır.

(ii)      Kürekli bir tekne bu Kurallarda yelkenli tekne için belirtilen fenerleri gösterebilir. Bunu yapmadığı takdirde çatışmayı önleyecek kadar yeterli bir  süre içinde, gösterilmek üzere, bir elektrikli cep fenerini veya beyaz bir ışık gösteren ve yanık halde bulunan bir feneri el altında hazır bulunduracaktır.

(e)     Yelkenle seyreden ve aynı zamanda makine ile de yürütülen bir tekne baş tarafında ve ufkun her tarafından en iyi görülebilecek bir yerine sivri ucu aşağı doğru olan bir koni gösterecektir.

KURAL: 26
Balıkçı Tekneleri

(a)     Balıkçılıkla uğraşan bir tekne üzerinde yol bulunduğu veya demirli olduğu zamanlarda,sadece bu Kuralda belirtilen fenerleri ve şekilleri gösterecektir.

(b)     Balıkçılık takımı olarak tarama ağları veya diğer takımları kullanarak  su içinde sürükleme anlamına gelen trol çekme işiyle uğraşan bir tekne;

(i)      Üstteki yeşil alttaki beyaz renkte olan ve dikey bir doğru üzerinde bulunan ve ufkun her tarafından görülür iki fener veya dikey bir doğru üzerinde ve biri diğerinin üstünde tepeleri birbirine bitişik iki koni gösterecek, boyu 20  metreden kısa olan bir tekne, bu şekiller yerine bir sepet gösterebilecektir.  

(ii)      Ufkun her tarafından görülen yeşil fenerin üstünde ve gerisinde bir silyon feneri gösterecek ve boyu 50 metreden kısa olan bir tekne böyle bir feneri göstermek zorunluluğunda olmayacak fakat isterse gösterebilecektir.

(iii)     Su üzerinde yol alırken bu paragrafta belirtilen fenerlere ek olarak borda fenerlerini ve bir pupa fenerini gösterecektir.

(c)     Trol çekmek dışında balıkçılakla uğraşan bir tekne;

(i)      Üstteki kırmızı, alttaki beyaz renkte olan ve dikey bir doğru üzerinde bulunan, ufkun her tarafından görülür iki fener veya dikey bir doğrultuda ve biri diğerinin üstünde tepeleri birbirine bitişik iki koni gösterecek, boyu 20 metreden kısa olan bir tekne bu şekil yerine, bir sepet gösterebilecektir. 

(ii)      Denize döşedikleri takımlar tekneden yatay olarak 150 metreden daha  açığa doğru uzandığı takdirde, takımlar doğrultusunda ufkun her tarafından görülür beyaz bir fener veya tepesi yukarı doğru olan bir koni şekli gösterecektir.

(iii)     Su üzerinde yol alırken, bu paragrafta belirtilen fenerlere ek olarak borda fenerlerini ve pupa fenerini de gösterecektir.

(d)     Balıkçılıkla uğraşan diğer teknelerin çok yakınında bulunan ve balıkçılıkla uğraşan bir tekne, bu Kuralların II sayılı lahikasında belirlenen ek işaretleri de gösterecektir.

(e)     Balıkçılıkla uğraşmadığı zaman bir tekne bu Kuralda belirtilen fener ve şekilleri göstermeyecek ve fakat ancak kendi boyundaki bir tekne için belirtilen fenerleri gösterecektir.

KURAL: 27
Kumanda Altında Bulunmayan veya Manevra Gücü Kısıtlı Olan Tekneler

(a)     Kumanda altında bulunmayan bir tekne:

(i)      En iyi görülebilecek yerde dikey bir doğru üzerinde ufkun her tarafından görülür iki kırmızı fener,

(ii)      En iyi görülebilecekleri yerde, dikey bir doğru üzerinde iki küre veya benzeri şekilleri,

(iii)     Su üzerinde ilerlerken, bu paragrafta belirtilen fenerlere ek olarak, borda fenerleri ve bir pupa feneri gösterecektir.

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Mayın temizleme faaliyetleri ile uğraşan bir tekne dışında manevra gücü kısıtlı bir tekne:

(i)      En iyi görülebilecekleri bir yerde dikey bir doğru üzerinde her yönden görünür,üç fener gösterecektir. Bu fenerlerden en üstteki ve en alttaki kırmızı, ortadaki beyaz olacaktır.

(ii)      En iyi görülebilecekleri bir yerde, dikey bir doğru üzerinde üç şekil gösterecektir. Bu şekillerden en üstteki ve en alttaki küre, ortadaki eşkenar dörtgen şeklinde olacaktır.

(iii)     Su üzerinde ilerlerken alt paragraf (i)'de belirtilen fenerlere ek  olarak, bir silyon feneri ya da fenerleri ve borda fenerleri ile bir pupa fenerini gösterecektir.

(iv)     Demirli iken bu Kuralın (i) ve (ii) sayılı alt paragraflarında belirtilen fenerler veya şekillere ek olarak, 30 uncu Kuralda belirtilen fenerleri ve  şekli gösterecektir.

(c)     Rotasından saptırma gücü bulunmayan yedekleme işi ile uğraşan,bir tekne, bu kuralın (b) (i) ve (ii) sayılı alt paragraflarında belirtilen fenerler veya şekillere ek olarak, 24 (a) sayılı kuralda belirtilen fenerleri veya şekli gösterecektir.

(d)     (Değişik: 20.9.1984 - 84/8541 K.) Tarama veya su altı işleri ile uğraşan bir tekne manevra yapabilme gücünü kısıtlı olduğu zamanlarda, bu Kuralın alt paragraflar (b) (i), (ii) ve (iii) de belirtilen fenerler şekilleri gösterecek ve ve engel mevcut olduğu zamanlarda da bunlara ek olarak:

(i)      Engelin bulunduğu tarafı işaret etmek üzere dikey bir doğru üzerinde her yönden görülür iki kırmızı fener veya iki küre;

(ii)      Diğer teknenin geçebileceği tarafı işaret etmek üzere, dikey bir doğru üzerinde her yönden görünür iki yeşil fener veya iki eşkenar dörtgen.

(iii)     Demirli iken Kural 30'da belirtilen fenerler ya da şekller yerine bu paragrafta belirtilen fenerler ya da şekilleri gösterecektir.

(e)     (Değişik: 20.9.1984 - 84/8541 K.) Dalgıç işleri ile uğraşan bir tekne bu Kuralın (d) paragrafında belirtilen fenerleri ve şekilleri göstermesi pratik olmadığı hallerde ağağıdakiler gösterilecektir.

(i)      Dikey bir hat üzerinde her yönden görünür üç fener teknenin en iyi görünen bir yerinde gösterilecektir. Bu fenerlerin en üst ve alttaki kırmızı, ortada bulunan ise beyaz olacaktır.

(ii)      Uluslararası kodunun "A" flamasının yüksekliği 1 metreden az olmayan bükülmez sağlam bir eşi gösterilecektir. Bu flamanın her yönden görülebilmesi için tüm önlemler alınacaktır.

(f)      (Değişik: 20.9.1984 - 84/8541 K.) Mayın temizleme işleri ile uğraşan bir tekne, 23 sayılı Kural'da kuvvetle yürütülen bir tekne için belirtilen fenerlere ya da demirli bulunan tekneler için Kural 30'da belirtilen fenerler ya da şekile ek olarak her yönden görünür üç yeşil fener ya da üç küre gösterecektir. Bu fenerlerden ya da şekillerden biri pruva direği başı yakınında ve pruva direği sereni cundalarında birer adet gösterilecektir. Bu fenerler ve şekiller diğer gemi için, mayın temizleyen gemiye 1000 metreden daha fazla yaklaşmanın tehlikeli olacağını gösterir.

(g)     (Değişik: 20.9.1984 - 84/8541 K.) Dalgıç işlerinde çalışanlar hariç olmak üzere, boyları l2 metreden küçük olan teknelerden bu Kuralda belirtilen fenerleri ve şekilleri göstermeleri istenmeyecektir.

(h)     Bu Kuralda belirtilen işaretler tehlikede olan ve yardım isteyen teknelerin işaretleri değildir. Bu işaretler, bu Kuralların IV. lahikasında bulunmaktadır.

KURAL : 28
Su Çekimleri Nedeniyle Seyirleri Kısıtlı Olan Tekneler

Su çekimleri nedeniyle seyirleri kısıtlı olan tekneler 23 sayılı Kuralda kuvvetle yürütülen tekneler için belirtilen fenerlere ek olarak, en iyi görülebilecek bir yerde, ufkun her tarafından görülen ve dikey bir doğru üzerinde  bulunan üç kırmızı fener veya bir silindir gösterebilir.

KURAL : 29
Kılavuz Tekneleri

(a)     (Değişik : 20.9.1984 - 84/8541 K.) Kılavuzluk görevi ile uğraşan bir tekne :

(i)      Direk başı veya direk başına yakın bir yerde her yönden görünür ve dikey bir doğru üzerinde üstteki beyaz, alttaki kırmızı olan iki fener,

(ii)      Seyir halinde olduğu zaman bunlara ek olarak, borda fenerleri ile bir pupa feneri,

(iii)     Demirde iken alt paragraf (i) de belirtilen fenerlere ek olarak Kural 30 da demirde bulunan tekneler için belirtilen fener, fenerler ya da şekiller gösterilecektir.

(b)     Bir kılavuz teknesi kılavuzluk görevi ile uğraşmadığı zaman kendi boyundaki benzeri bir tekne için belirtilen fenerler veya şekilleri gösterecektir.

KURAL: 30
Demirli ve Karaya Oturmuş Tekneler

(a)     Demirli olan bir tekne en iyi görülebilecek bir yerinde:

(i)      Baştarafında,ufkun her tarafından görülen bir beyaz fener veya bir küre,

(ii)      Kıç veya kıç tarafa yakın bir yerinde ve alt paragraf (i) de belirtilen fenerden daha az yükseklikte ufkun her tarafından görülen bir beyaz fener, gösterecektir.

(b)     Boyu 50 metreden daha kısa olan bir tekne bu kuralın (a) paragrafında belirtilen fenerler yerine en iyi görülebilecek bir yerinde ufkun her tarafından görülen bir beyaz fener gösterebilir.

(c)     Demirli bir tekne isterse ve boyu 100 metre ve daha uzun olan bir tekne zorunlu olarak güvertelerini, sağlanabilen iş veya buna eşit ışıklarla aydınlatacaklardır.

(d)     Karaya oturan bir tekne bu kuralın (a) veya (b) paragraflarında belirtilen fenerleri gösterecek ve bunlara ek olarak, en iyi görülebilecek yerlerinde,

(i)      Dikey bir doğru üzerinde,ufkun her tarafından görülen iki kırmızı fener,

(ii)      Dikey bir doğru üzerinde üç küre, gösterecektir.

(e)     (Değişik: 20.9.1984 - 84/8541 K.) Boyu 7 metreden kısa olan ve dar bir kanal veya geçit içinde veya demir yerinde ve diğer teknelerin normal olarak seyir yaptığı alanlarda veya bunlara yakın yerlerde olmamak üzere demirlemiş olan bir tekneden bu Kuralın (a) ve (b) paragraflarında belirtilen fenerleri ve şekilleri göstermesi istenmeyecektir,

(f)      (Ek: 20.9.1984 - 84/8541 K.) Boyu 12 metreden küçük olan bir tekne karaya oturduğu zaman bu Kuralın (d) (i) ve (ii) alt paragraflarında belirtilen fenerleri ve şekilleri göstermesi istenmiyecektir.

KURAL: 31
Deniz Uçakları

Bir deniz uçağı için, bu bölümdeki kurallarda belirtilen özellikler veya pozisyonlardaki fenerlerin ve şekillerin konulmasının mümkün olmaması halinde, bu özellikler ve pozisyonlardaki fenerler ve şekillere mümkün olduğu kadar yakın olan fenerleri ve şekilleri gösterecektir.

BÖLÜM D - SES VE IŞIK İŞARETLERİ

KURAL: 32
Tanımlamalar

(a)     "Düdük" sözcüğü belirtilen düdük seslerini meydana getirme gücünde olan ve bu Kuralların III sayılı Lahikası niteliklerine uyan herhangi bir sesle işaret verme aleti anlamına gelecektir.

(b)     "Kısa düdük" deyimi  : Bir saniye süreli bir düdük sesi anlamına gelecektir.

(c)     "Uzun düdük" deyimi : 4 - 6 saniye süreli bir düdük sesi anlamına gelecektir.

KURAL: 33
Ses İşaretleri İçin Aletler

(a)     (Değişik: 20.9.1984 - 84/8541 K.) Boyu 12 metre veya daha uzun olan bir teknede bir düdük ve bir kampana ve boyu 100 metre veya daha uzun olan bir teknede bunlara ek olarak bir gong bulunacak ve bu kongun tonu ve sesi kampananınki ile karıştırılmayacak şekilde olacaktır. Düdük, kampana ve gong bu Tüzüğün III  sayılı Ek'indeki niteliklerine uyacaktır. Belirtilen ses işaretlerinin elle verilmesine her zaman olanak bulunması şartıyla, kampana veya gong veya her ikisinin yerine aynı ses niteliğine sahip olan diğer bir alet konulabilir.

(b)     Boyları 12 metreden daha kısa olan tekneler bu kuralın (a) paragrafında belirtilen ses ile işaret veren aletleri taşıma zorunluğunda olmayacaklardır.   Böyle bir aleti bulunmayan bir teknede yeterli ses işareti verebilecek başka bir alet bulundurulacaktır.

KURAL: 34
Manevra ve Uyarma İşaretleri

(a)     Kuvvetle yürütülen ve seyir halinde bulunan bir tekne diğerini gördüğü zaman, bu kurallar uyarınca manevra yaptığında düdüğü ile aşağıdaki işaretleri vererek bu manevrasını belli edecektir.

- Bir kısa düdük    "Rotamı sancağa doğru değiştiriyorum".

- İki kısa düdük    "Rotamı iskeleye doğru değiştiriyorum".

- Üç kısa düdük    "Tornistan çalıştırıyorum".  anlamına gelecektir.

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Herhangi bir tekne bu kuralın (a) paragrafında belirtilen düdük işaretlerine ek olarak, manevra esnasında uygun bir surette tekrarlanacak olan ışıklı bir işaret de gösterebilir.

(i)      Bu ışıklı işaretler aşağıda yazılı olduğu gibi yorumlanacaktır:

         - Bir çakar "Rotamı sancağa değiştiriyorum".

         - İki çakar   "Rotamı iskeleye değiştiriyorum".

         - Üç çakar "Tornistan çalıştırıyorum". anlamına gelecektir.

(ii)      Her çakar, yaklaşık olarak bir saniye, iki çakar arasındaki süre yaklaşık olarak bir saniye sürecektir. Birbiri ardından verilecek işaretler arasındaki süre 10 saniyeden az olmayacaktır.

(iii)     Var ise bu işaret için kullanılacak olan ışık, her yönden görünür beyaz bir ışık olacak ve en azından 5 milden görülecek ve bu kurallara Ek 1 hükümlerine uyacaktır.

(c)     Dar bir kanal veya geçitte birbirini gören teknelerden: 9 (e) (i) sayılı kurala uyarak diğerine yetişip geçme niyetinde olan bir tekne düdükle aşağıdaki işaretleri vererek niyetini bildirecektir:

- İki uzun düdüğü takibeden bir kısa düdük:

"Senin sancak tarafından yetişip geçmek niyetindeyim"

- İki uzun düdüğü takibeden iki kısa düdük:

"Senin iskele tarafından yetişip geçmek niyetindeyim"

anlamına gelecektir.

(ii)      Yetişilip geçilecek olan bir tekne 9 (e) (i) sayılı kurala uyarak hareket ediyorsa, mutabakatını aşağıda yazılı işaret düdüğü ile vererek yetişen gemiye bildirecektir:

- Bir uzun,bir kısa,bir uzun ve bir kısa sırasıyla verilecek düdük işareti.

 

(d)     Birbirini gören iki teknenin birbirine yaklaşması ve bu teknelerden birini diğerinin niyetini ve hareketlerini anlayamaması veya çatışmayı önlemek üzere yeteri kadar harekete geçtiğinden tereddüde düşmesi halinde, tereddüde düşen tekne düdüğü ile derhal en azından beş kısa ve seri işaret vererek böyle bir tereddüt içinde olduğunu gösterecektir. Böyle bir işaret en azından beş kısa ve seri çakmalar şeklinde bir ışık işareti ile kuvvetlendirilebilir.

 

(e)     Araya giren bir engel sebebiyle diğer teknelerin görülmesine olanak bulunmayan bir kanal veya geçidin dönüş yerine yaklaşan bir tekne uzun bir düdük çalacaktır, Dönüş yerinin öbür tarafında veya aradaki engelin arkasında olan ve düdüğün duyulabileceği mesafede bulunan herhangi bir yaklaşan tekne de uzun bir düdükle bu işarete cevap verecektir.

(f)      Bir teknede aralarındaki mesafe 100 metreden fazla olan birden çok düdük mevcut olduğu takdirde manevra ve uyarma işaretleri sadece bir düdükle verilecektir.

KURAL: 35
Kısıtlı Görüş Hallerinde Verilecek Ses İşaretleri

Görüş şartları kısıtlı olan bir alan içinde veya yakınında,gece veya gündüz, bu Kuralda belirtilen işaretler aşağıda yazılı olduğu gibi kullanılacaklardır: 

(a)     Üzerinde yol bulunan kuvvetle yürütülen bir tekne iki dakikadan fazla olmayan aralıklarla bir uzun düdük çalacaktır.

(b)     Yolda olan fakat durup su üzerinde ilerlemeyen, kuvvetle yürütülen bir  tekne iki dakikadan fazla olmayan aralıklarla birbiri ardından iki uzun düdük çalacak ve bu iki düdük arasında da yaklaşık iki saniyelik süre bulunacaktır.

(c)     Kumanda altında bulunmayan, manevra yapma gücü kısıtlı olan, su çekimi nedeniyle kısıtlı olan, yelkenli tekne balıkçılıkla uğraşan diğer bir tekneyi çekerek veya yedekleme işi ile uğraşan bir tekne, bu kuralın (a) veya (b) paragraflarında belirtilen işaretler yerine aralarında iki dakikadan fazla bir süre olmayan aralıklarla üç düdüğü birbiri ardından çalacak ve bu üç düdükten birisi uzun olacak ve bunu iki kısa düdük takip edecektir.

(d)     (Değişik: 20.9.1984 - 84/8541 K.) Balıkçılıkla uğraşan bir tekne demirde iken ve demirde işini yaparken manevrası kısıtlı olan bir tekne bu Kuralın (g) paragrafında belirtilen işaretler yerine bu Kuralın (c) paragrafında belirtilen ses işaretini verecektir.

(e)     İterek yedekleyen bir tekne ile bunun önünde ileri itilerek yedeklenen bir teknenin birleşik bir birim teşkil etmek üzere birbirlerine sıkıcı bağlandıkları durumda bunlar kuvvetle yürütülen bir tekne gibi sayılacak ve bu kuralın (a) veya (b) paragraflarında belirtilen işaretleri göstereceklerdir.

(f)      Demirli olan bir tekne bir dakikadan daha uzun olmayan aralıklarla, seri bir şekilde ve yaklaşık olarak beş saniye süre ile bir kampana çalacaktır. Boyları 100 metre veya daha uzun olan teknelerde kampana teknenin baş tarafından ses verecek ve kampananın çalınmasından hemen sonra teknenin kıç tarafından bir gong yaklaşık olarak, beş saniye süre ile ses verecektir. Demirli olan bir tekne ek olarak, yaklaşan bir tekneye bulunduğu yeri ve çatışma olasılığını ihtar etmek üzere, bir kısa bir uzun ve yine bir kısa olmak üzere birbiri ardından üç düdük çalabilir.

(g)     Karaya oturan bir tekne bu kuralın (f) paragrafında belirtilen kampana işaretini, gerekiyorsa gong işaretini verecek, buna ek olarak, kampanasını çalmaya başlamadan hemen önce ve kampana çalınması bittikten hemen sonra kampanasına üç ayrı ve belirgin darbeli vuruşlar yapacaktır. Karaya oturan bir tekne ek olarak, uygun düdük işareti de verebilir.

(h)     Boyu 12 metreden daha kısa olan bir tekne yukarda belirlenen işaretleri vermek zorunluluğunda olmayacak, vermediği takdirde, aralarında iki dakikadan fazla süre bulunmayan diğer bir yeterli ses işareti verecektir.

(i)      Kılavuzluk görevi ile uğraşan bir kılavuz teknesi bu kuralın (a) (b) veya (f) paragraflarında belirtilen ses işaretlerine ek olarak, dört kısa düdükten oluşan bir tanınma işareti verebilir.

KURAL: 36
Dikkat çekme İşaretleri

(Değişik: 20.9.1984 - 84/8541 K.)

Gerekli olduğu takdirde herhangi bir tekne bu Kurallarda verilmesi istenen işaretlerle karıştırılmamak üzere, diğer bir teknenin dikkatini çekmek için ışık ve ses işaretleri verebilir veya herhangi bir tekneyi güç duruma düşürmemek üzere projektörünü tehlike yönüne doğru çevirebilir.

Diğer bir geminin dikkatini çekmek için kullanılan herhangi bir ışık,herhangi bir seyire yardımcının yanlış anlaşılmasına neden olmayacaktır. Bu Kuralın amacına uygun olarak yüksek şiddette fasılalı ya da döner ışıkların kullanılmasından kaçınılacaktır.

KURAL: 37
Tehlike İşaretleri

Tehlike içinde bulunan ve yardım isteyen bir tekne bu Tüzüğün IV sayılı Ek'inde tarif edilen işaretleri kullanacak veya gösterecektir.

BÖLÜM E - İSTİSNALAR

KURAL: 38
İstisnalar

(Değişik: 20.9.1984 - 84/8541 K.)

1960 Uluslararası Denizde Çatışmayı Önleme Tüzüğü gereklerine uyması şartıyla, bu Tüzüğün yürürlüğe girdiği tarihte omurgası atılmış olan veya inşa durumu buna benzer bir halde bulunan bir tekne (veya bir sınıf tekneler) aşağıda yazılı olduğu şekilde bu Kurallara uymaktan istisna edilebilirler.

(a)     Bu Tüzüğün yürürlüğe gireceği tarihten sonra geçecek dört yıl sonuna kadar 22 nci Kuralda belirtilen mesafeleri ile beraber fenerlerin yerlerine konulmasından,

(b)     Bu Tüzüğün yürürlüğe gireceği tarihten sonra geçecek dört yıl sonuna kadar Bu Tüzüğün 1 sayılı Ek'inin 7 nci kısmında renk nitelikleri belirtilen fenerlerin yerlerine konulmasından,

(c)     İngiliz Kraliyet sisteminden metrik birim sistemine dönülmesi ve ölçü rakamlarını, yuvarlak bir hale getirilmesi sonucu olarak, fenerlerin yeniden yerleştirilmesinden sürekli,

(d)

(i)      Bu Tüzüğün Ek 1 (3) (a) kısmında belirtilenlerin sonucu olarak boyları 150 metreden daha kısa olan teknelerin silyon fenerlerinin yeniden yerleştirilmesinden sürekli,

(ii)      Bu Tüzüğün yürürlüğe gireceği tarihten sonra geçecek 9 yıl sonuna kadar bu Tüzüğün 1. Ek'inin 3 (a) kısmında belirtilenlerin sonucu olarak boyları 150 metre veya daha uzun olan teknelerin silyon fenerlerinin yeniden yerleştirilmesinden.                                                                        

(e)     Bu Tüzüğün yürürlüğe gireceği tarihten sonra geçecek 9 yıl sonuna kadar Bu Tüzüğün 1'inci Ek, 2 (b) önerileri sonucu olarak silyon fenerlerinin yeniden yerleştirilmesinden,

(f)      Bu Tüzüğün yürürlüğe gireceği tarihten sonra geçecek 9 yıl sonuna kadar 1'inci Ek, Kısım 2 (g) ve 3 (b) de belirtilenlerin sonucu olarak borda fenerlerinin yeniden yerleştirilmesinden,

(g)     Bu Tüzüğün yürürlüğe gireceği tarihten sonra geçecek 9 yıl sonuna kadar Bu Tüzüğün III. Ek'de belirtilen ses işareti aletleri için konuları hükümlerden istisnalar yapılabilir.

(h)     (Ek: 20.9.1984 - 84/8541 K.) Bu Tüzüğün Ek 1, Kısım 9 (b) de belirtilen her yönden görünür fenerlerin tekrar yerleştirilmesi sürekli istisna yapılabilir.

LAHİKA  1

FENERLERİN VE ŞEKİLLERİN YERLEŞTİRİLMELERİ
VE TEKNİK AYRINTILARI

1.      (Değişik: 20.9.1984 - 84/8541 K.) Tanımlama:
"Tekne üstünden yükseklik" deyimi: En üstteki devamlı güverte üzerinden olan yükseklik demektir. Bu yükseklik fenerin yerleştirildiği yerin altından dikey olarak ölçülecektir.

2.      Fenerlerin dikey yerleştirilmeleri ve aralarındaki mesafe:

(a)     Boyları 20 metre veya daha uzun olan ve kuvvetle yürütülen teknelerin silyon fenerleri aşağıdaki şekilde yerleştirilecektir:

(i)      Pruva silyon feneri, veya sadece bir silyon feneri taşıyorsa bu fener tekneden 6 metreden daha az olmayan bir yükseklikte olacak ve teknenin genişliği 6 metreden daha fazla olduğu takdirde, bu fenerin tekneden yüksekliği bu genişlikten daha az olmayacak, fakat fenerin tekneden 12 metreden daha fazla yükseklikte bulunması zorunlu olmayacaktır.

(ii)      Çift silyon feneri mevcut olduğu takdirde, grandi silyonu pruva silyonundan dikey olarak en az 4,5 metre daha yüksekte olacaktır.

(b)     Kuvvetle yürütülen teknelerdeki silyon fenerlerinin dikey ayrımı Trimin bütün normal koşullarında deniz seviyesinden ve bodoslamanın bin metre ilerisinden bakıldığı zaman gradi silyonunun pruva silyonundan ayrı ve pruva silyonunun üzerinde görülmesini sağlayacak bir nitelikte olacaktır.

(c)     Boyları 12 metre veya 20 metreden daha kısa olan ve kuvvetle yürütülen teknelerin silyon feneri küpeşteden 2,5 metreden daha az olmayan bir yüksekliğe konulacaktır.

(d)     Boyu 12 metreden kısa olan, kuvvetle yürütülen bir tekne en yüksekte bulunması gerekli fenerini küpeşteden 2,5 metreden daha az yükseklikte bulundurabilir. Ancak, borda fenerleri veya pupa fenerine ek olarak bir silyon feneri mevcut olduğu zaman, bu silyon feneri, borda fenerlerinin bulunduğu yerden en azından 1 metre daha yükseklikte bulundurulacaktır.

(e)     (Değişik: 20.9.1984 - 84/8541 K.) Diğer bir tekneyi iterek veya çekerek yedekleyen kuvvetle yürütülen bir teknede bulundurulacak olan iki veya üç silyon fenerlerinden biri  pruva silyonu ya da grandi silyon feneri olarak aynı yere konulacak ancak grandi silyonu olarak konulduğunda en altta bulunan grandi silyon feneri dikey olarak pruva silyon fenerinden  en az 4.5 metre daha yukarıda olacaktır.

(i)      Alt paragraf (ii) de tarif edilenin dışında Kural 23 (a) belirtilen silyon feneri ya da fenerleri diğer fenerler ve engellerin üzerinde ve neta olmak üzere yerleştirileceklerdir.

(ii)      Kural 27 (b) (i) ya da Kural 28 de belirtilen her yönden görünür fenerlerin silyon fenerlerinin altına konulması pratik değilse bunlar grandi silyon fener(ler)i üstüne konulabilir ya da pruva silyon fener(ler)i ile grandi silyon fener(ler)i arasına dikey olarak konulabilir ancak son durumda bu Ek'in 3 (c) maddesinde istenilen yerine getirilmiş olacaktır.

(g)     Kuvvetle yürütülen bir teknenin borda fenerleri, aynı teknenin pruva silyonu fenerinin tekneden olan yüksekliğinin dörtte üçünden daha yukarı konulmayacaktır. Bu borda fenerleri güverte ışıklarıyla karıştırılabilecekleri kadar da aşağıya konulmayacaktır.

(h)     Boyu 20 metreden kısa olan ve kuvvetle yürütülen bir teknenin borda fenerleri birleşik bir fanus içinde taşındığı zaman; bu fanus bir metreden daha az olmamak üzere silyon fenerinin altına yarleştirilmiş olacaktır.

(i)      (Değişik: 20.9.1984 - 84/8541 K.) Kuralların dikey bir doğru üzerinde iki veya üç fener taşınmasını belirttiği zamanlarda, bunların arasındaki mesafe, aşağıda yazılı olduğu gibi olacaktır:

(i)      Boyu 20 metre veya daha fazla olan bir teknede bu fenerler birbirinden 2 metreden daha az olmayan bir mesafeye konulacak, bir yedekleme feneri bulundurulması istenilen durum hariç bu fenerlerden en altta bulunan, tekne üstünden olan yüksekliği 4 metreden daha az olmayan bir yere konulacaktır.

(ii)      Boyu 20 metreden daha kısa olan bir teknede bu fenerler birbirinden 1  metreden daha az olmayan bir mesafeye konulacak, bir yedekleme feneri bulundurulması istenilen durum hariç bu fenerlerden en altta bulunan, tekne üstünden  olan yüksekliği 2 metreden daha az olmayan bir yere konulacaktır.

(iii)     Üç fener taşındığı zaman, bu fenerler arasındaki mesafeler eşit olacaktır.

(j)      (Değişik: 20.9.1984 - 84/8541 K.) Bir tekne balıkçılıkla uğraştığı zaman belirtilen her yönden görünür iki fenerden altta olanı, iki dikey fener arasındaki mesafenin iki katından daha az olmamak üzere borda fenerlerinin üzerindeki bir yükseklikte olacaktır.

(k)     (Değişik: 20.9.1984 - 84/8541 K.) İki demir feneri taşıyan gemilerde Kural 30 (a) (i)'de belirtilen baştaraftaki demir feneri, kıç tarafdakinden 4.5'metre'den daha aşağıya konmayacaktır. Boyu 50 metre ya da daha fazla olan teknelerde baş tarafdaki demir feneri, tekne üstünden olan yüksekliği 6 metreden az olmayan bir yere konulacaktır.

 3. Fenerlerin Yatay Yerleştirilmeleri ve Aralarındaki mesafe:

(a)     Kuvvetle yürütülen bir tekne için iki silyon feneri istenildiği zaman, bunlar arasındaki yatay mesafe, gemi uzunluğunun yarısından az olmayacak fakat bu mesafenin 100 metreden fazla olmasına da gerek bulunmayacaktır. Baş taraftaki silyon feneri bodoslamadan itibaren gemi boyunun dörtte birinden daha uzağa konulmayacaktır.

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Boyu 20 metre veya daha fazla olan kuvvetle yürütülen bir teknede borda fenerleri, baş taraftaki silyon fenerlerinin önünde bulunmayacaktır. Bu fenerler teknenin bordasına veya bordasına yakın bir yere konulacaktır.

(c)     (Ek: 20.9.1984 - 84/8541 K.) Kural 27 (b) (i) ya da Kural 28'de belirtilen fenerler pruva silyon fener(ler) ile grandi silyon fener(ler)i arasında dikey olarak konulduklarında, bu her yönden görünür fenerler, geminin kemere doğrultusunda, baş kıç merkez hattına yatay olarak 2 metreden daha az olmayan bir mesafeye konulacaktır.

 4.      Balıkçı tekneleri, tarak dubaları ve sualtı işleriyle uğraşan tekneler için yön gösteren fenerlerin bulunacakları yerlerin ayrıntıları:

(a)     Kural 26 (c) (ii)'de belirtilen balıkçılıkla uğraşan bir teknenin denize döşediği takımların yönünü gösteren fener, ufkun her tarafından görülen biri kırmızı, biri beyaz olan iki fenerden 2 metreden az ve 6 metreden çok olmayan yatay bir mesafeye konacaktır. Bu fener Kural 26 (c) (i) de belirtilen ufkun her tarafından görünür beyaz fenerden yukarıya, borda fenerlerinden de aşağıya konulmayacaktır.

(b)     Tarama işleriyle veya sualtı işleriyle uğraşan bir teknede bulunacak olan Kural 27 (d) (i) ve(ii) de belirtildiği şekilde engelli olan veya emniyetle geçilebilecek olan tarafı gösteren fener ve şekiller uygulanabildiği kadar en fazla yatay mesafeye konulacak fakat bunlar hiçbir zaman Kural 27 (b) (i) ve (ii) de belirtilen fener ve şekillerden 2 metreden daha yakın mesafeye konulmayacaktır. Bu fenerlerden veya şekillerden üstte bulunanı hiçbir zaman Kural 27  (b) (i) ve (ii) de belirtilen üç fener veya şeklin en altta olanından daha yüksekte olamayacaktır.

 5.      (Değişik: 20.9.1984 - 84/8541 K.) Borda fenerleri için siperlikler:

         20 metre boyunda ya da daha uzun olan teknelerde borda fenerlerinin iç kısımları bu Ek'in 9 uncu kısmı hükümlerine uymak üzere, mat siyah boyalı siperliklerle donatılacaktır. Eğer bu Ek'in 9. maddesindeki istekleri yerine getirmek gerekiyorsa boyu 20 metreden küçük olan teknelerin borda fenerleri içi siyah mat siperliklerle donatılacaktır. Bir dikey filaman kullanan ve yeşil ve kırmızı kısımları arasında çok dar bir bölme bulunan birleşik bir fanusta dış siperlikler konulmasına gerek bulunmayacaktır.

6. Şekiller

(a)     Şekiller siyah ve aşağıda yazılı ölçülerde olacaklardır:

(i)      Bir kürenin 0.6 metreden daha az olmayan bir çapı olacaktır.

(ii)      Bir koninin 0.6 metreden daha az olmayan bir taban çapı olacak ve yüksekliği de çapına eşit olacaktır.

(iii)     Bir silindirin en az 0.6 metre olan bir çapı olacak ve yüksekliği de çapının iki katı olacaktır.

(iv)     Bir eşkenar dörtgen şekli, yukarda (ii) sayılı tali paragrafta belirlenen müşterek bir taban üzerinde iki koniden oluşacaktır.

(b)     Şekiller arasındaki dikey mesafe en az 1,5 metre olacaktır.

(c)     Boyu 20 metreden kısa olan bir teknede daha küçük ve fakat teknenin boyutları ile orantılı şekiller kullanılabilir ve aralarındaki mesafe buna paralel olarak azaltılabilir.

 7.      Fener ışıklarının rengine ait teknik özellikleri:

         Tüm seyir fenerlerinin rengi Uluslararası Aydınlatma Komisyonu (CIE) tarafından belirtilen renk diagramının alanının sınırları içinde bulunan aşağıda yazılı değerlere uyacaktır.

         Köşe koordinatları gösterilmek suretiyle her renk alanının sınırları aşağıda gösterildiği gibidir:

(a)     Fenerlerin minimum ışık şiddeti aşağıda yazılı formül kullanılarak hesabedilecektir.

         I = 3,43 x 10 üzeri 6 x T x D üzeri 2 x K - D

         Bu formülde;
I   : Hizmet koşulları altında mum olarak ışık şiddetidir:
T  : (2x10 - üzeri 7) lüx olarak ışık şiddetinin başlangıç değeri.
D : Işığın deniz mili olarak görünebilme mesafesi (Aydınlatma mesafesi).
K : Atmosferik geçirgenliği.

         Meteorolojik görüş mesafesinin yaklaşık olarak 13 deniz mili oluşuna karşılık K değeri, belirtilen fenerler için 0,8 olacaktır.

         Ancak, bu değişken kontrol kullanılarak yapılmayacaktır.

 

9. Yatay dilimler:

(a)     (Değişik: 20.9.1984 - 84/8541 K.)

(i)      Gemilere monte edilen borda fenerleri ileri yönde istenilen ışığı minimum şiddette gösterecektir. Belirtilen sektörler dışında 1 ve 3 üncü dereceler arasında ışık şiddeti pratik olarak tamamen kesilmiş izlenimi verebilecek şekilde azaltılmalıdır.

(ii)      Pupa fenerleri, silyon fenerleri ve borda fenerleri için de kemere doğrultusunun 22.5 derece gerisinde, istenilen en az şiddetler 21 inci Kuralda belirtilen dilimlerin sektörleri içinde ufuktan itibaren uzaya doğru 5 derecelik yay yapacak şekilde tutulacaktır. Belirtilen sektörlerin içinde 5 dereceden sonra belirtilen şiddet sınırlara kadar % 50 civarında azaltılabilir. Belirtilen sınırların dışında 5 dereceyi geçmemek üzere veya pratik olarak gözle görülmeyecek hale getirilinceye kadar şiddet sürekli olarak azaltılacaktır.

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Her yönden görünür fenerler; Kural 30'da belirtilen ve tekneden pratik olmıyan bir yüksekliğe konmasına gerek bulunmayan demir fenerleri hariç, direklerin gabya çubuklarının veya diğer yapıların, bu fenerlerin görünüşlerini 6 dereceden fazla kapamıyacakları yerlere konacaktır.

 

10.     (a) (Değişik: 20.9.1984 - 84/8541 K.) Dikey dilimler:

         Yelkenli teknelerdeki fenerler hariç donatılan elektrikli fenerlerin dikey dilimleri:

(i)      Yatay düzlemin 5 derece üstü ve 5 derece altındaki her açıda istenilen minimum şiddetin muhafaza ettirilmesini.

(ii)      Yatay düzlemin 7,5 derece üstünde ve 7,5 derece altında istenilen minumum şiddetin % 60'ının muhafaza ettirilmesini sağlayacak nitelikte olacaktır.

 

(b)     (Değişik: 20.9.1984 - 84/8541 K.) Yelkenli teknelerde donatılan elektrikli fenerlerin dikey dilimleri:

(i)      Yatay düzlemin 5 derece altı ve 5 derece üstündeki her açıda istenilen minimum şiddetin muhafaza ettirilmesini,

(ii)      Yatay düzlemin 25 derece üstünde ve 25 derece altında istenilen minimum şiddetin % 50'sinin muhafaza ettirilmesini; sağlayacak nitelikte olacaktır.

 

(c)     Elektrikli olmayan fenerlerde bu özelliklere mümükün olduğu kadar, uyulmaya çalışılacaktır.

 11.     Elektrikli olmıyan fenerlerin şiddeti:

         Elektrikli olmayan fenerler bu Lahikanın 8 inci kısmındaki tabloda belirlenen minimum şiddetlere mümkün olduğu kadar uyacaklardır.

12.     Bu Lahikanın 2 (f) sayılı hükmüne bakılmaksızın 34 (b) sayılı Kuralda belirtilen manevra ışığı, uygulanabildiği kadar pruva silyon fenerinin en az 2 metre dikey olarak üstüne, ancak grandi silyon fenerinin dikey olarak 2 metre  altında veya üstünde olmamak ve silyon feneri veya fenerlerinin aynı düşey düzlemi üzerinde bulunmak üzere, konulacaktır. Sadece bir silyon feneri olan teknede, varsa manevra ışığı, silyon fenerinden dikey olarak 2 metreden daha az olmamak üzere en iyi görülen yere konulacaktır.

13.     (Değişik: 20.9.1984 - 84/8541 K.) Onay:

         Fenerlerin ve şekillerin yapısı ve fenerlerin teknede yerlerine konulması teknenin bayrığını çekmeye hak sahibi olduğu devletin gerekli yetkiyi verdiği makamları tatmin edici bir tarzda olacaktır.

 LAHİKA: II

BİRBİRLERİNE YAKIN BİR HALDE BALIKÇILIK YAPAN
BALIKÇI TEKNELERİ İÇİN EK İŞARETLER

1.      Genel olarak:

         Burada sözkonusu edilen fenerler, Kural 26 (d) hükümlerine uygun olarak gös terildikleri takdirde, en iyi görülebilecekleri yerlere konulacaklardır. Bunlar, en azından, birbirinden 0,9 metre aralıklı olacak fakat Kural 26 (b) (i) ve (c)  (i)'de belirtilen fenerlerden daha aşağı bir seviyede bulunacaklardır. Fenerler  ufkun her tarafından ve en az 1 milden, fakat bu kurallarda balıkçı tekneleri  için belirtilen fenerlerden daha az bir mesafeden bile görülebileceklerdir.

 2.      Trol için olan işaretler:

(a)     İster dip veya ister yüzey ağ takımları kullansın Trol işiyle uğraşan tekneler:

(i)      Ağlarını atarken;  Dikey bir doğru üzerinde iki beyaz fener;

(ii)      Ağlarını toplarken;  Dikey bir doğru üzerinde kırmızı bir fener üstünde beyaz  bir fener;

(iii)     Ağın bir engele takılması halinde: Dikey bir doğru üzerinde iki kırmızı fener gösterebilirler.

 (b)     Birlikte trol ile uğraşan iki tekneden herbiri:

(i)      Geceleyin çifti teşkil eden diğer teknenin doğrultusunda ve ileriye doğru yönetilen bir projektör ışığı ile,

(ii)      Ağlarını atarken veya toplarken veya ağlarının bir engele takılması halinde yukarda 2 (a) da belirtilen fenerleri; gösterebilirler.

 3.      Torbalı ağ için olan işaretler:

         Torbalı ağ ile balıkçılık yapmakla uğraşan tekneler dikey bir doğru üzerinde ki sarı fener gösterebilir. Bu fenerler her saniyede bir münavabe ile parlayacak ve sönük kalma süresi ışık süresine eşit olacaktır. Bu fenerler sadece teknenin balık avlama takımları tarafından engellendiği zamanlarda gösterilebilirler.

SESLE İŞARET VEREN ALETLERİN TEKNİK AYRINTILARI

1. Düdükler:

(a)     Frekanslar ve duyulma mesafeleri
İşaretin esas frekansı 70 - 700 Hz bandı içerisinde olacaktır.
Düdükten verilen işaretin duyulabilme mesafesi:

         180 - 700 Hz (+ - Yüzde 1) bandı içinde bulunan ve aşağıda yazılı 1 (c) paragrafında belirtilen ses basınç seviyelerini sağlayan esas frekansları ve/veya bir veya daha yüksek frekansları da içeren bu frekanslarla saptanacaktır.

(b)     Başlıca frekans sınırları:

         Çok çeşitli düdük özelliklerini sağlamak üzere, bir düdüğün esas frekansı aşağıda yazılı olan sınırlar içinde olacaktır:

(i)      Boyları 200 metre veya daha uzun olan gemilerde 70 - 200 Hz.;

(ii)      Boyu 75 metreden uzun, 200 metreden kısa olan gemilerde 130 - 350 Hz.;

(iii)     Boyu 75 metreden kısa olan bir gemide 250 - 700 Hz.

(c)     Ses işaretinin şiddeti ve duyulma mesafesi:

         Bir gemiye yerleştirilmiş bir düdük, düdüğün maksimum şiddeti doğrultusunda ve düdükten 1 metre uzaklıkta 100-700 Hz. (+ - yüzde 1) frekans bandları içinde en azından bandın yarısının 1/3'ü nisbetinde bir ses basınç seviyesi sağlayacak ve bu aşağıdaki tabloda verilen uygun rakamlardan az almayacaktır. Yukarki tabloda belirtilen duyulma mesafesi bilgi içindir ve bu mesafe dinleme mevkilerinde mevcut fon gürültülerinin ortalama bir seviyede olduğu hallerde, geminin güvertesinde sakin hava koşullarında geminin ilerisindeki ekseninde düdüğün % 90 olasılıkla duyulabileceği bir mesafedir. 250 Hz orta frekansı olan yarım band genişliği içerisinde 68 dB olarak alındığında ve orta frekansı  500 Hz olan yarım band da 63 dB olarak alınmıştır. Uygulamada bir düdüğün duyulabileceği mesafe son derece değişiklikler gösterir ve büyük çapta hava koşullarına dayanır. Verilen değerler tipik olarak sayılabilir, fakat dinleme mevkilerinde sert rüzgar veya çevre gürültü koşulları altında mesafe çok miktarda azalabilir.

 (d)     (Değişik: 20.9.1984 - 84/8541 K.) Yönsel Özellikler:

         Sesi yönlendirilmiş düdüklerde, bir düdüğün ses basınç seviyesi, aynı sesin herhangi bir eksen yönünde ve yatay düzlemde + 45 derece yapan yöndeki belirtilen ses basınç seviyesinden 4 dB den daha aşağı olmayacaktır. Yatay bir düzlem  üzerinde 45 dereceden fazla herhangi bir diğer yöndeki ses basınç seviyesi,eksen üzerindeki belirtilen ses basınç seviyesindekinden 10 dB den daha aşağı olmayacak, ön eksendekinin en az yarısı olacaktır. Ses basınç seviyesi duyulabilme mesafesini saptayan bu 1/3 oktav bandında ölçülecektir.

 (e)     Düdüklerin yerleri:

         Sesi yönlendirilmiş bir düdüğün bir teknedeki tek düdük olarak kullanılacağı hallerde, bu düdüğün maksimum şiddeti tam pruvaya yöneltilmek üzere yerine monte edilecektir.

         Verilen sesin engeller tarafından durdurulmasını azaltmak gemi personelinin duyma zararı rizikosunu minimuma indirmek amacıyla bir düdük bir teknede mümkün olduğu kadar yükseğe konulacaktır. Bir teknenin kendi işaretinin dinleme mevkilerindeki ses basınç seviyesi 110 dB (A), mümkün olursa 100 dB (A) yı geçmeyecektir.

(f)      Birden fazla düdükle donatma:

         Düdükler, aralarında 100 metreden fazla bir mesafe bulunacak şekilde tekneye yerleştirildiği zaman, bunların aynı anda öttürülmemeleri için gerekli düzenlemeler yapılacaktır.

 (g)     Birleşik düdük sistemi:

         Engellerin varlığı dolayısiyle yukarda 1 (f) paragrafında söz konusu edilen tek düdük veya düdüklerin ses alanı içinde ses seviyesi çok azalan bölgelerin var olması olasılığı bulunduğu takdirde, bu azalmanın üstesinden gelmek üzere birleşik düdük sisteminin yerleştirilmesi önerilebilir. Kuralların amaçları için bir birleşik düdük sistemine tek bir düdük gözü ile bakılacaktır.

         Birleşik düdük sisteminde düdükler birbirlerinden 100 metreden daha uzak mesafeye konulmayacak, aynı anda öttürülmeleri için gerekli tedbirler alınacaktır. Bir düdüğün frakansı, diğerlerinin frekansından en az 10 Hz faklı olacaktır.

 2. (Değişik: 20.9.1984 - 84/8541 K.) Kampana veya gong:

(a)     İşaret şiddeti:

         Bir kampana veya gong veya benzeri ses özelliği olan diğer herhangi bir alet, ondan m metre mesafede 110 dB den az olmayan bir ses basınç seviyesi meydana getirecek güçte olacaktır.

(b)     Yapımlar:

         Kampana veya gonglar paslanmaya dayanıklı bir maddeden ve berrak bir ton verebilecekleri bir şekilde yapılacaklardır.

         Yapılacak kampananın ağız çapı: Boyları 20 metre ya da daha fazla olan tekneler için 300 mm'den, boyları 12 metre ya da daha fazla fakat 20 metreden az olan tekneler için 200 mm'den daha az olmayacaktır. Mümkün olduğu takdirde devamlı bir tesir sağlamak üzere makine ile hareket eden bir kampana vurucusu önerilebilir. Fakat elle çalıştırma her zaman mümkün olacaktır. Kampana tokmağının ağırlığı kampana ağırlığının yüzde 3'ünden daha az olmayacaktır.

3.      (Değişik: 20.9.1984 - 84/8541 K.) Onay:

         Ses işaret aletlerinin yapımı, bunların iş görme ve tekneye montesi, teknenin bayrağını çekmeye hak sahibi olduğu Devletin yetkili kıldığı uygun makamları tatmin edici nitelikte olacaktır.

 LAHİKA: IV
TEHLİKE İŞARETLERİ

1.      Aşağıda yazılı işaretler birlikte veya ayrı ayrı kullanıldığı veya gösterildiği zaman, tehlikeyi ve yardım ihtiyacını gösterecektir.

(a)     Yaklaşık olarak 1'er dakika ara ile patlatılan bir top veya diğer bir patlayıcı işaret;

(b)     Herhangi bir sis işaret aletinin devamlı olarak çalınması;

(c)     Kısa aralıklarla her seferinde kırmızı yıldızlar saçan roket veya mermi atılması;

(d)     Mors kodu ile ... --- ... (SOS)'den ibaret bir grup işaretin telsiz telgraf veya herhangi bir diğer işaret verme metodu ile gönderilmesi;

(e)     "Mayday" kelimesinin söylenmesinden ibaret bir işaretin telsiz telefonla gönderilmesi;

(f)      N.C. harfleriyle Uluslararası Tehlike işaret kodunun gösterilmesi;

(g)     Üzerinde veya altında bir küre veya küreye benzer herhangi bir şey bulunan dört köşe bir bayraktan ibaret bir işaret;

(h)     Yanan bir katran veya yağ varili veya benzerinden çıkan alevlerin gemi üzerinde gösterilmesi;

(i)      Paraşütlü bir roket maytabı veya kırmızı ışık gösteren bir el maytabı; 

(j)      Portakal rengi duman veren bir duman işareti;

(k)     Her iki yana doğru açılan kolların ağır ağır ve tekrarlı olarak indirilip kaldırılması;

(l)      Telsiz telgraf alarm işareti;

(m)    Telsiz telefon alarm işareti;

(n)     Acil mevkileri belirtmek üzere radyo kerterizleri yayınlayan vericiler.

 2.      Tehlike ve yardım istekleri hususlarının bildirilmesi hariç, yukarıda yazılı işaretlerin kullanılması veya gösterilmesi ve yukarıda yazılı bu işaretlerle karıştırılabilecek diğer işaretlerin kullanılması yasaklanmıştır.

 3.      Uluslararası İşaret Kodunun ilgili bölümleri Ticaret Gemileri Arama, ve Kurtarma El Kitabı ve aşağıda yazılı işaretlere

(a)     Havadan bakanların tanımaları için portakal rengi bir yelken bezi üzerine ya siyah kare veya daire veya diğer bir uygun sembol;

(b)     Bir boya marka edici'ye dikkat çekilir.

Rule 1

 

Application — International

 

(a)

These Rules shall apply to all vessels upon the high seas and in all waters connected therewith navigable by seagoing vessels.

(b)

Nothing in these Rules shall interfere with the operation of special rules made by an appropriate authority for roadsteads, harbours, rivers, lakes or inland waterways connected with the high seas and navigable by sea-going vessels if such special rules conform as closely as possible to these Rules.

(c)

Nothing in these Rules shall interfere with the operation of any special rules made by the government of any state with respect to additional station or signal lights, shapes or whistle signals for ships of war and vessels proceeding under convoy, or with respect to additional station or signal lights or shapes for fishing vessels engaged in fishing as a fleet. These additional station or signal lights, shapes or whistle signals shall, so far as possible, be such that they cannot be mistaken for any light, shape or signal authorized elsewhere under these Rules.

(d)

Traffic separation schemes may be adopted by the Organization for the purpose of these Rules.

(e)

Where the Government concerned determines that a vessel of special construction or purpose cannot comply fully with the provisions of any of these Rules with respect to the number, position, range or arc of visibility of lights or shapes, as well as to the disposition and characteristics of sound-signalling appliances, the vessel shall comply with such other provisions in regard to the number, position, range or arc of visibility of lights or shapes, as well as to the disposition and characteristics of sound-signalling appliances as the Government determines to be the closest possible compliance with these Rules in respect of that vessel.

Rule 2

 

Responsibility

 

(a)

Nothing in these Rules shall exonerate any vessel, or the owner, master or crew thereof, from the consequences of any neglect to comply with these Rules or of the neglect of any precaution which may be required by the ordinary practice of seamen, or by the special circumstances of the case.

(b)

In construing and complying with these Rules due regard shall be had to all dangers of navigation and collision and to any special circumstances, including the limitations of the vessels involved, which may make a departure from these Rules necessary to avoid immediate danger.

Rule 3

 

General Definitions — International

 

For the purpose of these Rules, except where the context otherwise requires:

(a)

The word “vessel” includes every description of water craft, including non-displacement craft, WIG craft and seaplanes, used or capable of being used as a means of transportation on water.

(b)

The term “power-driven vessel” means any vessel propelled by machinery.

(c)

The term “sailing vessel” means any vessel under sail provided that propelling machinery, if fitted, is not being used.

(d)

The term “vessel engaged in fishing” means any vessel fishing with nets, lines, trawls or other fishing apparatus which restrict manoeuvrability, but does not include a vessel fishing with trolling lines or other fishing apparatus which do not restrict manoeuvrability.

(e)

The word “seaplane” includes any aircraft designed to manoeuvre on the water.

(f)

The term “vessel not under command” means a vessel which through some exceptional circumstance is unable to manoeuvre as required by these Rules and is therefore unable to keep out of the way of another vessel.

(g)

The term “vessel restricted in her ability to manoeuvre” means a vessel which from the nature of her work is restricted in her ability to manoeuvre as required by these Rules and is therefore unable to keep out of the way of another vessel.

The term “vessels restricted in their ability to manoeuvre” shall include but not be limited to:

(i) a vessel engaged in laying, servicing or picking up a navigation mark, submarine cable or pipeline,

(ii) a vessel engaged in dredging, surveying or underwater operations,

(iii) a vessel engaged in replenishment or transferring persons, provisions or cargo while underway,

(iv) a vessel engaged in the launching or recovery of aircraft,

(v) a vessel engaged in mineclearance operations,

(vi) a vessel engaged in a towing operation such as severely restricts the towing vessel and her tow in their ability to deviate from their course.

(h)

The term “vessel constrained by her draught” means a power-driven vessel that, because of the vessel’s draught in relation to the available depth and width of navigable water, is severely restricted in the vessel’s ability to deviate from the course the vessel is following.

(i)

The word “underway” means that a vessel is not at anchor, or made fast to the shore, or aground.

(j)

The words “length” and “breadth” of a vessel mean her length overall and greatest breadth.

(k)

Vessels shall be deemed to be in sight of one another only when one can be observed visually from the other.

(l)

The term “restricted visibility” means any condition in which visibility is restricted by fog, mist, falling snow, heavy rainstorms, sandstorms or any other similar causes.

(m)

The term “Wing-in-Ground (WIG) craft” means a multimodal craft which, in its main operational mode, flies in close proximity to the surface by utilizing surface-effect action.

 

PART B — STEERING AND SAILING RULES

SECTION I — CONDUCT OF VESSELS IN ANY CONDITION OF VISIBILITY

Rule 4

 

Application

 

Rules in this Section apply in any condition of visibility.

Rule 5

 

Look-out

 

Every vessel shall at all times maintain a proper look-out by sight and hearing as well as by all available means appropriate in the prevailing circumstances and conditions so as to make a full appraisal of the situation and of the risk of collision.

Rule 6

 

Safe Speed — International

 

Every vessel shall at all times proceed at a safe speed so that she can take proper and effective action to avoid collision and be stopped within a distance appropriate to the prevailing circumstances and conditions.

In determining a safe speed the following factors shall be among those taken into account:

(a)

By all vessels:

(i) the state of visibility,

(ii) the traffic density including concentrations of fishing vessels or any other vessels,

(iii) the manoeuvrability of the vessel with special reference to stopping distance and turning ability in the prevailing conditions,

(iv) at night the presence of background light such as from shore lights or from back scatter of her own lights,

(v) the state of wind, sea and current, and the proximity of navigational hazards,

(vi) the draught in relation to the available depth of water.

(b)

Additionally, by vessels with operational radar:

(i) the characteristics, efficiency and limitations of the radar equipment,

(ii) any constraints imposed by the radar range scale in use,

(iii) the effect on radar detection of the sea state, weather and other sources of interference,

(iv) the possibility that small vessels, ice and other floating objects may not be detected by radar at an adequate range,

(v) the number, location and movement of vessels detected by radar,

(vi) the more exact assessment of the visibility that may be possible when radar is used to determine the range of vessels or other objects in the vicinity.

 

Rule 7

 

Risk of Collision

(a)

Every vessel shall use all available means appropriate to the prevailing circumstances and conditions to determine if risk of collision exists. If there is any doubt such risk shall be deemed to exist.

(b)

Proper use shall be made of radar equipment if fitted and operational, including long-range scanning to obtain early warning of risk of collision and radar plotting or equivalent systematic observation of detected objects.

(c)

Assumptions shall not be made on the basis of scanty information, especially scanty radar information.

(d)

In determining if risk of collision exists the following considerations shall be among those taken into account:

(i) such risk shall be deemed to exist if the compass bearing of an approaching vessel does not appreciably change,

(ii) such risk may sometimes exist even when an appreciable bearing change is evident, particularly when approaching a very large vessel or a tow or when approaching a vessel at close range.

Rule 8

 

Action to avoid Collision

 

(a)

Any action to avoid collision shall be taken in accordance with the Rules of this Part and shall, if the circumstances of the case admit, be positive, made in ample time and with due regard to the observance of good seamanship.

(b)

Any alteration of course and/or speed to avoid collision shall, if the circumstances of the case admit, be large enough to be readily apparent to another vessel observing visually or by radar; a succession of small alterations of course and/or speed should be avoided.

(c)

If there is sufficient sea room, alteration of course alone may be the most effective action to avoid a close-quarters situation provided that it is made in good time, is substantial and does not result in another close-quarters situation.

(d)

Action taken to avoid collision with another vessel shall be such as to result in passing at a safe distance. The effectiveness of the action shall be carefully checked until the other vessel is finally past and clear.

(e)

If necessary to avoid collision or allow more time to assess the situation, a vessel shall slacken her speed or take all way off by stopping or reversing her means of propulsion.

(f)

(i) A vessel which, by any of these Rules, is required not to impede the passage or safe passage of another vessel shall, when required by the circumstances of the case, take early action to allow sufficient sea room for the safe passage of the other vessel.

(ii) A vessel required not to impede the passage or the safe passage of another vessel is not relieved of this latter obligation if approaching the other vessel so as to involve risk of collision and shall, when taking action, have full regard to the action which may be required by the rules of this Part.

(iii) A vessel the passage of which is not to be impeded remains fully obliged to comply with the rules of this Part when the two vessels are approaching one another so as to involve risk of collision.

Rule 9

 

Narrow Channels — International

 

(a)

A vessel proceeding along the course of a narrow channel or fairway shall keep as near to the outer limit of the channel or fairway which lies on her starboard side as is safe and practicable.

(b)

A vessel of less than 20 metres in length or a sailing vessel shall not impede the passage of a vessel which can safely navigate only within a narrow channel or fairway.

(c)

A vessel engaged in fishing shall not impede the passage of any other vessel navigating within a narrow channel or fairway.

(d)

A vessel shall not cross a narrow channel or fairway if such crossing impedes the passage of a vessel which can safely navigate only within such channel or fairway. The latter vessel may use the sound signal prescribed in Rule 34(d) if in doubt as to the intention of the crossing vessel.

(e)

(i) In a narrow channel or fairway when overtaking can take place only if the vessel to be overtaken has to take action to permit safe passing, the vessel intending to overtake shall indicate her intention by sounding the appropriate signal prescribed in Rule 34(c)(i). The vessel to be overtaken shall, if in agreement, sound the appropriate signal prescribed in Rule 34(c)(ii) and take steps to permit safe passing. If in doubt she may sound the signals prescribed in Rule 34(d).

(ii) This Rule does not relieve the overtaking vessel of her obligation under Rule 13.

(f)

A vessel nearing a bend or an area of a narrow channel or fairway where other vessels may be obscured by an intervening obstruction shall navigate with particular alertness and caution and shall sound the appropriate signal prescribed in Rule 34(e).

(g)

Any vessel shall, if the circumstances of the case admit, avoid anchoring in a narrow channel.

 

Rule 10

 

Traffic Separation Schemes — International

 

(a)

This rule applies to traffic separation schemes adopted by the Organization and does not relieve any vessel of her obligation under any other rule.

(b)

A vessel using a traffic separation scheme shall:

(i) proceed in the appropriate traffic lane in the general direction of traffic flow for that lane,

(ii) so far as practicable keep clear of a traffic separation line or separation zone,

(iii) normally join or leave a traffic lane at the termination of the lane, but when joining or leaving from either side shall do so at as small an angle to the general direction of traffic flow as practicable.

(c)

A vessel shall, so far as practicable, avoid crossing traffic lanes but, if obliged to do so, shall cross on a heading as nearly as practicable at right angles to the general direction of traffic flow.

(d) (i) A vessel shall not use an inshore traffic zone when it can safely use the appropriate traffic lane within the adjacent traffic separation scheme. However, vessels of less than 20 metres in length, sailing vessels and vessels engaged in fishing may use the inshore traffic zone.

(ii) Notwithstanding subparagraph (i), a vessel may use an inshore traffic zone when en route to or from a port, an offshore installation or structure, a pilot station or any other place situated within the inshore traffic zone or to avoid immediate danger.

(e)

A vessel other than a crossing vessel or a vessel joining or leaving a lane shall not normally enter a separation zone or cross a separation line except

(i) in cases of emergency to avoid immediate danger, or

(ii) to engage in fishing within a separation zone.

(f)

A vessel navigating in areas near the terminations of traffic separation schemes shall do so with particular caution.

(g)

A vessel shall so far as practicable avoid anchoring in a traffic separation scheme or in areas near its terminations.

(h)

A vessel not using a traffic separation scheme shall avoid it by as wide a margin as is practicable.

(i)

A vessel engaged in fishing shall not impede the passage of any vessel following a traffic lane.

(j)

A vessel of less than 20 metres in length or a sailing vessel shall not impede the safe passage of a power-driven vessel following a traffic lane.

(k)

A vessel restricted in her ability to manoeuvre when engaged in an operation for the maintenance of safety of navigation in a traffic separation scheme is exempted from complying with this Rule to the extent necessary to carry out the operation.

(l)

A vessel restricted in her ability to manoeuvre when engaged in an operation for the laying, servicing or picking up of a submarine cable, within a traffic separation scheme, is exempted from complying with this Rule to the extent necessary to carry out the operation.

 

SECTION II — CONDUCT OF VESSELS IN SIGHT OF ONE ANOTHER

Rule 11

 

Application

 

Rules in this Section apply to vessels in sight of one another.

Rule 12

Sailing Vessels

 

(a)

When two sailing vessels are approaching one another, so as to involve risk of collision, one of them shall keep out of the way of the other as follows:

(i) when each has the wind on a different side, the vessel which has the wind on the port side shall keep out of the way of the other,

(ii) when both have the wind on the same side, the vessel which is to windward shall keep out of the way of the vessel which is to leeward,

(iii) if a vessel with the wind on the port side sees a vessel to windward and cannot determine with certainty whether the other vessel has the wind on the port or on the starboard side, she shall keep out of the way of the other.

(b)

For the purposes of this Rule, the windward side shall be deemed to be the side opposite to that on which the mainsail is carried or, in the case of a square-rigged vessel, the side opposite to that on which the largest fore-and-aft sail is carried.

Rule 13

 

Overtaking — International

 

(a)

Notwithstanding anything contained in the Rules of Part B, Sections I and II, any vessel overtaking any other vessel shall keep out of the way of the vessel being overtaken.

(b)

A vessel shall be deemed to be overtaking when coming up with another vessel from a direction more than 22.5 degrees abaft her beam, that is, in such a position with reference to the vessel she is overtaking, that at night she would be able to see only the sternlight of that vessel but neither of her sidelights.

(c)

When a vessel is in any doubt as to whether she is overtaking another, she shall assume that this is the case and act accordingly.

(d)

Any subsequent alteration of the bearing between the two vessels shall not make the overtaking vessel a crossing vessel within the meaning of these Rules or relieve her of the duty of keeping clear of the overtaken vessel until she is finally past and clear.

 

Rule 14

 

Head-on Situation

(a)

When two power-driven vessels are meeting on reciprocal or nearly reciprocal courses so as to involve risk of collision, each shall alter her course to starboard so that each shall pass on the port side of the other.

(b)

Such a situation shall be deemed to exist when a vessel sees the other ahead or nearly ahead and by night she could see the masthead lights of the other in a line or nearly in a line and/or both sidelights and by day she observes the corresponding aspect of the other vessel.

(c)

When a vessel is in any doubt as to whether such a situation exists she shall assume that it does exist and act accordingly.

Rule 15

 

Crossing Situation — International

 

(a)

When two power-driven vessels are crossing so as to involve risk of collision, the vessel which has the other on her own starboard side shall keep out of the way and shall, if the circumstances of the case admit, avoid crossing ahead of the other vessel.

Crossing Situation — Canadian Modification

 

(b)

Notwithstanding paragraph (a), in Canadian waters, a vessel crossing a river shall keep out of the way of a power-driven vessel ascending or descending the river, except on the St. Lawrence River seaward of Île Rouge.

Rule 16

 

Action by Give-way Vessel

 

Every vessel which is directed to keep out of the way of another vessel shall, so far as possible, take early and substantial action to keep well clear.

Rule 17

 

Action by Stand-on Vessel

 

(a)

(i) Where one of two vessels is to keep out of the way, the other shall keep her course and speed.

(ii) The latter vessel may however take action to avoid collision by her manoeuvre alone, as soon as it becomes apparent to her that the vessel required to keep out of the way is not taking appropriate action in compliance with these Rules.

(b)

When, from any cause, the vessel required to keep her course and speed finds herself so close that collision cannot be avoided by the action of the give-way vessel alone, she shall take such action as will best aid to avoid collision.

(c)

A power-driven vessel which takes action in a crossing situation in accordance with subparagraph (a)(ii) of this Rule to avoid collision with another power-driven vessel shall, if the circumstances of the case admit, not alter course to port for a vessel on her own port side.

(d)

This Rule does not relieve the give-way vessel of her obligation to keep out of the way.

Rule 18

 

Responsibilities between Vessels

 

Except where Rules 9, 10 and 13 otherwise require:

(a)

A power-driven vessel underway shall keep out of the way of:

(i) a vessel not under command,

(ii) a vessel restricted in her ability to manoeuvre,

(iii) a vessel engaged in fishing,

(iv) a sailing vessel.

(b)

A sailing vessel underway shall keep out of the way of:

(i) a vessel not under command,

(ii) a vessel restricted in her ability to manoeuvre,

(iii) a vessel engaged in fishing.

(c)

A vessel engaged in fishing when underway shall, so far as possible, keep out of the way of:

(i) a vessel not under command,

(ii) a vessel restricted in her ability to manoeuvre.

(d)

(i) Any vessel other than a vessel not under command or a vessel restricted in her ability to manoeuvre shall, if the circumstances of the case admit, avoid impeding the safe passage of a vessel constrained by her draught, exhibiting the signals in Rule 28.

(ii) A vessel constrained by her draught shall navigate with particular caution having full regard to her special condition.

(e)

A seaplane on the water shall, in general, keep well clear of all vessels and avoid impeding their navigation. In circumstances, however, where risk of collision exists, she shall comply with the Rules of this Part.

(f)

(i) A WIG craft shall, when taking off, landing and in flight near the surface, keep well clear of all other vessels and avoid impeding their navigation.

(ii) A WIG craft operating on the water surface shall comply with the Rules of this Part as a

power-driven vessel.

 

SECTION III — CONDUCT OF VESSELS IN RESTRICTED VISIBILITY

Rule 19

 

Conduct of Vessels in Restricted Visibility

 

(a)

This Rule applies to vessels not in sight of one another when navigating in or near an area of restricted visibility.

(b)

Every vessel shall proceed at a safe speed adapted to the prevailing circumstances and conditions of restricted visibility. A power-driven vessel shall have her engines ready for immediate manoeuvre.

(c)

Every vessel shall have due regard to the prevailing circumstances and conditions of restricted visibility when complying with the Rules of Section I of this Part.

(d)

A vessel which detects by radar alone the presence of another vessel shall determine if a close-quarters situation is developing and/or risk of collision exists. If so, she shall take avoiding action in ample time, provided that when such action consists of an alteration of course, so far as possible the following shall be avoided:

(i) an alteration of course to port for a vessel forward of the beam, other than for a vessel being overtaken,

(ii) an alteration of course towards a vessel abeam or abaft the beam.

(e)

Except where it has been determined that a risk of collision does not exist, every vessel which hears apparently forward of her beam the fog signal of another vessel, or which cannot avoid a close-quarters situation with another vessel forward of her beam, shall reduce her speed to the minimum at which she can be kept on her course. She shall if necessary take all her way off and in any event navigate with extreme caution until danger of collision is over.

 

PART C — LIGHTS AND SHAPES

Rule 20

 

Application

 

(a)

Rules in this Part shall be complied with in all weathers.

(b)

The Rules concerning lights shall be complied with from sunset to sunrise, and during such times no other lights shall be exhibited, except such lights as cannot be mistaken for the lights specified in these Rules or do not impair their visibility or distinctive character, or interfere with the keeping of a proper look-out.

(c)

The lights prescribed by these Rules shall, if carried, also be exhibited from sunrise to sunset in restricted visibility and may be exhibited in all other circumstances when it is deemed necessary.

(d)

The Rules concerning shapes shall be complied with by day.

(e)

The lights and shapes specified in these Rules shall comply with the provisions of Annex I to these Regulations.

Rule 21

 

Definitions — International

 

(a)

“Masthead light” means a white light placed over the fore and aft centreline of the vessel showing an unbroken light over an arc of the horizon of 225 degrees and so fixed as to show the light from right ahead to 22.5 degrees abaft the beam on either side of the vessel.

(b)

“Sidelights” means a green light on the starboard side and a red light on the port side each showing an unbroken light over an arc of the horizon of 112.5 degrees and so fixed as to show the light from right ahead to 22.5 degrees abaft the beam on its respective side. In a vessel of less than 20 metres in length the sidelights may be combined in one lantern carried on the fore and aft centreline of the vessel.

(c)

“Sternlight” means a white light placed as nearly as practicable at the stern showing an unbroken light over an arc of the horizon of 135 degrees and so fixed as to show the light 67.5 degrees from right aft on each side of the vessel.

(d)

“Towing light” means a yellow light having the same characteristics as the “sternlight” defined in paragraph (c) of this Rule.

(e)

“All-round light” means a light showing an unbroken light over an arc of the horizon of 360 degrees.

(f)

“Flashing light” means a light flashing at regular intervals at a frequency of 120 flashes or more per minute.

 

Rule 22

 

Visibility of Lights — International

 

The lights prescribed in these Rules shall have an intensity as specified in section 8 of Annex I to these Regulations so as to be visible at the following minimum ranges:

(a)

In vessels of 50 metres or more in length:

— a masthead light, six miles,

— a sidelight, three miles,

— a sternlight, three miles,

— a towing light, three miles,

— a white, red, green or yellow all-round light, three miles.

(b)

In vessels of 12 metres or more in length but less than 50 metres in length:

— a masthead light, five miles; except that where the length of the vessel is less than 20 metres, three miles,

— a sidelight, two miles,

— a sternlight, two miles,

— a towing light, two miles,

— a white, red, green or yellow all-round light, two miles.

(c)

In vessels of less than 12 metres in length:

— a masthead light, two miles,

— a sidelight, one mile,

— a sternlight, two miles,

— a towing light, two miles,

— a white, red, green or yellow all-round light, two miles.

(d)

In inconspicuous, partly submerged vessels or objects being towed:

— a white all-round light, three miles.

 

Rule 23

 

Power-driven Vessels Underway — International

 

(a)

A power-driven vessel underway shall exhibit:

(i) a masthead light forward,

(ii) a second masthead light abaft of and higher than the forward one; except that a vessel of less than 50 metres in length shall not be obliged to exhibit such light but may do so,

(iii) sidelights,

(iv) a sternlight.

(b)

An air cushion vessel when operating in the non-displacement mode shall, in addition to the lights prescribed in paragraph (a) of this Rule, exhibit an all-round flashing yellow light.

(c)

A WIG craft only when taking off, landing and in flight near the surface shall, in addition to the lights prescribed in paragraph (a) of this Rule, exhibit a high intensity all-round flashing red light.

(d)

(i) A power-driven vessel of less than 12 metres in length may in lieu of the lights prescribed in paragraph (a) of this Rule exhibit an all-round white light and sidelights.

(ii) A power-driven vessel of less than seven metres in length whose maximum speed does not exceed seven knots may in lieu of the lights prescribed in paragraph (a) of this Rule exhibit an all-round white light and shall, if practicable, also exhibit sidelights.

(iii) The masthead light or all-round white light on a power-driven vessel of less than 12 metres in length may be displaced from the fore and aft centreline of the vessel if centreline fitting is not practicable, provided that the sidelights are combined in one lantern which shall be carried on the fore and aft centreline of the vessel or located as nearly as practicable in the same fore and aft line as the masthead light or the all-round white light.

 

Rule 24

 

Towing and Pushing — International

 

(a)

A power-driven vessel when towing shall exhibit:

(i) instead of the light prescribed in Rule 23(a)(i) or (a)(ii), two masthead lights in a vertical line. When the length of the tow, measuring from the stern of the towing vessel to the after end of the tow exceeds 200 metres, three such lights in a vertical line,

(ii) sidelights,

(iii) a sternlight,

(iv) a towing light in a vertical line above the sternlight,

(v) when the length of the tow exceeds 200 metres, a diamond shape where it can best be seen.

(b)

When a pushing vessel and a vessel being pushed ahead are rigidly connected in a composite unit they shall be regarded as a power-driven vessel and exhibit the lights prescribed in Rule 23.

(c)

A power-driven vessel when pushing ahead or towing alongside, except in the case of a composite unit, shall exhibit:

(i) instead of the light prescribed in Rule 23(a)(i) or (a)(ii), two masthead lights in a vertical line,

(ii) sidelights,

(iii) a sternlight.

(d)

A power-driven vessel to which paragraph (a) or (c) of this Rule applies shall also comply with Rule 23(a)(ii).

(e)

A vessel or object being towed, other than those mentioned in paragraph (g) of this Rule, shall exhibit:

(i) sidelights,

(ii) a sternlight,

(iii) when the length of the tow exceeds 200 metres, a diamond shape where it can best be seen.

(f)

Provided that any number of vessels being towed alongside or pushed in a group shall be lighted as one vessel,

(i) a vessel being pushed ahead, not being part of a composite unit, shall exhibit at the forward end, sidelights,

(ii) a vessel being towed alongside shall exhibit a sternlight and at the forward end, sidelights.

(g)

An inconspicuous, partly submerged vessel or object, or combination of such vessels or objects being towed, shall exhibit:

(i) if it is less than 25 metres in breadth, one all-round white light at or near the forward end and one at or near the after end except that dracones need not exhibit a light at or near the forward end,

(ii) if it is 25 metres or more in breadth, two additional all-round white lights at or near the extremities of its breadth,

(iii) if it exceeds 100 metres in length, additional all-round white lights between the lights prescribed in subparagraphs (i) and (ii) so that the distance between the lights shall not exceed 100 metres,

(iv) a diamond shape at or near the aftermost extremity of the last vessel or object being towed and if the length of the tow exceeds 200 metres an additional diamond shape where it can best be seen and located as far forward as is practicable.

(h)

Where from any sufficient cause it is impracticable for a vessel or object being towed to exhibit the lights or shapes prescribed in paragraph (e) or (g) of this Rule, all possible measures shall be taken to light the vessel or object towed or at least to indicate the presence of such vessel or object.

(i)

Where from any sufficient cause it is impracticable for a vessel not normally engaged in towing operations to display the lights prescribed in paragraph (a) or (c) of this Rule, such vessel shall not be required to exhibit those lights when engaged in towing another vessel in distress or otherwise in need of assistance. All possible measures shall be taken to indicate the nature of the relationship between the towing vessel and the vessel being towed as authorized by Rule 36, in particular by illuminating the towline.

 

Rule 25

 

Sailing Vessels Underway and Vessels Under Oars — International

 

(a)

A sailing vessel underway shall exhibit:

(i) sidelights,

(ii) a sternlight.

(b)

In a sailing vessel of less than 20 metres in length the lights prescribed in paragraph (a) of this Rule may be combined in one lantern carried at or near the top of the mast where it can best be seen.

(c)

A sailing vessel underway may, in addition to the lights prescribed in paragraph (a) of this Rule, exhibit at or near the top of the mast, where they can best be seen, two all-round lights in a vertical line, the upper being red and the lower green, but these lights shall not be exhibited in conjunction with the combined lantern permitted by paragraph (b) of this Rule.

(d)

(i) A sailing vessel of less than seven metres in length shall, if practicable, exhibit the lights prescribed in paragraph (a) or (b) of this Rule, but if she does not, she shall have ready at hand an electric torch or lighted lantern showing a white light which shall be exhibited in sufficient time to prevent collision.

(ii) A vessel under oars may exhibit the lights prescribed in this Rule for sailing vessels, but if she does not, she shall have ready at hand an electric torch or lighted lantern showing a white light which shall be exhibited in sufficient time to prevent collision.

(e)

A vessel proceeding under sail when also being propelled by machinery shall exhibit forward where it can best be seen a conical shape, apex downwards.

 

Rule 26

 

Fishing Vessels

 

(a)

A vessel engaged in fishing, whether underway or at anchor, shall exhibit only the lights and shapes prescribed in this Rule.

(b)

A vessel when engaged in trawling, by which is meant the dragging through the water of a dredge net or other apparatus used as a fishing appliance, shall exhibit:

(i) two all-round lights in a vertical line, the upper being green and the lower white, or a shape consisting of two cones with their apexes together in a vertical line one above the other,

(ii) a masthead light abaft of and higher than the all-round green light; a vessel of less than 50 metres in length shall not be obliged to exhibit such a light but may do so,

(iii) when making way through the water, in addition to the lights prescribed in this paragraph, sidelights and a sternlight.

(c)

A vessel engaged in fishing, other than trawling, shall exhibit:

(i) two all-round lights in a vertical line, the upper being red and the lower white, or a shape consisting of two cones with their apexes together in a vertical line one above the other,

(ii) when there is outlying gear extending more than 150 metres horizontally from the vessel, an all-round white light or a cone apex upwards in the direction of the gear,

(iii) when making way through the water, in addition to the lights prescribed in this paragraph, sidelights and a sternlight.

(d)

The additional signals described in Annex II apply to a vessel engaged in fishing in close proximity to other vessels engaged in fishing.

(e)

A vessel when not engaged in fishing shall not exhibit the lights or shapes prescribed in this Rule, but only those prescribed for a vessel of her length.

(f)

Rule 27

 

Vessels not under Command or Restricted in their Ability to Manoeuvre

 

(a)

A vessel not under command shall exhibit:

(i) two all-round red lights in a vertical line where they can best be seen,

(ii) two balls or similar shapes in a vertical line where they can best be seen,

(iii) when making way through the water, in addition to the lights prescribed in this paragraph, sidelights and a sternlight.

(b)

A vessel restricted in her ability to manoeuvre, except a vessel engaged in mineclearance operations, shall exhibit:

(i) three all-round lights in a vertical line where they can best be seen. The highest and lowest of these lights shall be red and the middle light shall be white,

(ii) three shapes in a vertical line where they can best be seen. The highest and lowest of these shapes shall be balls and the middle one a diamond,

(iii) when making way through the water, a masthead light or lights, sidelights and a sternlight, in addition to the lights prescribed in subparagraph (i),

(iv) when at anchor, in addition to the lights or shapes prescribed in subparagraphs (i) and (ii), the light, lights or shape prescribed in Rule 30.

(c)

A power-driven vessel engaged in a towing operation such as severely restricts the towing vessel and her tow in their ability to deviate from their course shall, in addition to the lights or shapes prescribed in Rule 24(a), exhibit the lights or shapes prescribed in subparagraphs (b)(i) and (ii) of this Rule.

(d)

A vessel engaged in dredging or underwater operations, when restricted in her ability to manoeuvre, shall exhibit the lights and shapes prescribed in subparagraphs (b)(i), (ii) and (iii) of this Rule and shall in addition, when an obstruction exists, exhibit:

(i) two all-round red lights or two balls in a vertical line to indicate the side on which the obstruction exists,

(ii) two all-round green lights or two diamonds in a vertical line to indicate the side on which another vessel may pass,

(iii) when at anchor the lights or shapes prescribed in this paragraph instead of the lights or shape prescribed in Rule 30.

(e)

Whenever the size of a vessel engaged in diving operations makes it impracticable to exhibit all lights and shapes prescribed in paragraph (d) of this Rule, the following shall be exhibited:

(i) three all-round lights in a vertical line where they can best be seen. The highest and lowest of these lights shall be red and the middle light shall be white,

(ii) a rigid replica of the International Code flag “A” not less than one metre in height. Measures shall be taken to ensure its all-round visibility.

(f)

A vessel engaged in mineclearance operations shall, in addition to the lights prescribed for a power-driven vessel in Rule 23 or to the lights or shape prescribed for a vessel at anchor in Rule 30 as appropriate, exhibit three all-round green lights or three balls. One of these lights or shapes shall be exhibited near the foremast head and one at each end of the fore yard. These lights or shapes indicate that it is dangerous for another vessel to approach within 1 000 metres of the mineclearance vessel.

(g)

Vessels of less than 12 metres in length, except those engaged in diving operations, shall not be required to exhibit the lights and shapes prescribed in this Rule.

(h)

The signals prescribed in this Rule are not signals of vessels in distress and requiring assistance. Such signals are contained in Annex IV.

Rule 28

 

Vessels Constrained by their Draught — International

 

(a)

A vessel constrained by her draught may, in addition to the lights prescribed for power-driven vessels in Rule 23, exhibit where they can best be seen three all-round red lights in a vertical line, or a cylinder.

 

Rule 29

 

Pilot Vessels

 

(a)

A vessel engaged on pilotage duty shall exhibit:

(i) at or near the masthead, two all-round lights in a vertical line, the upper being white and the lower red,

(ii) when underway, in addition, sidelights and a sternlight,

(iii) when at anchor, in addition to the lights prescribed in subparagraph (i), the light, lights or shape prescribed in Rule 30 for vessels at anchor.

(b)

A pilot vessel when not engaged on pilotage duty shall exhibit the lights or shapes prescribed for a similar vessel of her length.

Rule 30

 

Anchored Vessels and Vessels Aground — International

 

(a)

A vessel at anchor shall exhibit where it can best be seen:

(i) in the fore part, an all-round white light or one ball,

(ii) at or near the stern and at a lower level than the light prescribed in subparagraph (i), an all-round white light.

(b)

A vessel of less than 50 metres in length may exhibit an all-round white light where it can best be seen instead of the lights prescribed in paragraph (a) of this Rule.

(c)

A vessel at anchor may, and a vessel of 100 metres and more in length shall, also use the available working or equivalent lights to illuminate her decks.

(d)

A vessel aground shall exhibit the lights prescribed in paragraph (a) or (b) of this Rule and in addition, where they can best be seen:

(i) two all-round red lights in a vertical line,

(ii) three balls in a vertical line.

(e)

A vessel of less than seven metres in length, when at anchor, not in or near a narrow channel, fairway or anchorage, or where other vessels normally navigate, shall not be required to exhibit the lights or shape prescribed in paragraphs (a) and (b) of this Rule.

(f)

A vessel of less than 12 metres in length, when aground, shall not be required to exhibit the lights or shapes prescribed in subparagraphs (d)(i) and (ii) of this Rule.

 

Rule 31

 

Seaplanes

 

Where it is impracticable for a seaplane or a WIG craft to exhibit lights and shapes of the characteristics or in the positions prescribed in the Rules of this Part she shall exhibit lights and shapes as closely similar in characteristics and position as is possible.

 

PART D — SOUND AND LIGHT SIGNALS

 

Rule 32

 

Definitions

 

(a)

The word “whistle” means any sound signalling appliance capable of producing the prescribed blasts and which complies with the specifications in Annex III to these Regulations.

(b)

The term “short blast” means a blast of about one second’s duration.

(c)

The term “prolonged blast” means a blast of from four to six seconds’ duration.

Rule 33

 

Equipment for Sound Signals — International

 

(a)

A vessel of 12 metres or more in length shall be provided with a whistle, a vessel of 20 metres or more in length shall be provided with a bell in addition to a whistle, and a vessel of 100 metres or more in length shall, in addition, be provided with a gong, the tone and sound of which cannot be confused with that of the bell. The whistle, bell and gong shall comply with the specification in Annex III to these Regulations. The bell or gong or both may be replaced by other equipment having the same respective sound characteristics, provided that manual sounding of the prescribed signals shall always be possible.

(b)

A vessel of less than 12 metres in length shall not be obliged to carry the sound signalling appliances prescribed in paragraph (a) of this Rule but if she does not, she shall be provided with some other means of making an efficient sound signal.

 

Rule 34

 

Manoeuvring and Warning Signals — International

 

(a)

When vessels are in sight of one another, a power-driven vessel underway, when manoeuvring as authorized or required by these Rules, shall indicate that manoeuvre by the following signals on her whistle:

— one short blast to mean “I am altering my course to starboard”,

— two short blasts to mean “I am altering my course to port”,

— three short blasts to mean “I am operating astern propulsion”.

(b)

Any vessel may supplement the whistle signals prescribed in paragraph (a) of this Rule by light signals, repeated as appropriate, whilst the manoeuvre is being carried out:

(i) these light signals shall have the following significance:

— one flash to mean “I am altering my course to starboard”,

— two flashes to mean “I am altering my course to port”,

— three flashes to mean “I am operating astern propulsion”,

(ii) the duration of each flash shall be about one second, the interval between flashes shall be about one second, and the interval between successive signals shall be not less than 10 seconds,

(iii) the light used for this signal shall, if fitted, be an all-round white light, visible at a minimum range of five miles, and shall comply with the provisions of Annex I.

(c)

When in sight of one another in a narrow channel or fairway:

(i) a vessel intending to overtake another shall in compliance with Rule 9(e)(i) indicate her intention by the following signals on her whistle:

— two prolonged blasts followed by one short blast to mean “I intend to overtake you on your starboard side”,

— two prolonged blasts followed by two short blasts to mean “I intend to overtake you on your port side”,

(ii) the vessel about to be overtaken when acting in accordance with Rule 9(e)(i) shall indicate her agreement by the following signal on her whistle;

— one prolonged blast, one short, one prolonged and one short blast, in that order.

(d)

When vessels in sight of one another are approaching each other and from any cause either vessel fails to understand the intentions or actions of the other, or is in doubt whether sufficient action is being taken by the other to avoid collision, the vessel in doubt shall immediately indicate such doubt by giving at least five short and rapid blasts on the whistle. Such signal may be supplemented by a light signal of at least five short and rapid flashes.

(e)

A vessel nearing a bend or an area of a channel or fairway where other vessels may be obscured by an intervening obstruction shall sound one prolonged blast. Such signal shall be answered with a prolonged blast by any approaching vessel that may be within hearing around the bend or behind the intervening obstruction.

(f)

If whistles are fitted on a vessel at a distance apart of more than 100 metres, one whistle only shall be used for giving manoeuvring and warning signals.

 

Rule 35

 

Sound Signals in Restricted Visibility — International

 

In or near an area of restricted visibility, whether by day or night, the signals prescribed in this Rule shall be used as follows:

(a)

A power-driven vessel making way through the water shall sound at intervals of not more than two minutes one prolonged blast.

(b)

A power-driven vessel underway but stopped and making no way through the water shall sound at intervals of not more than two minutes two prolonged blasts in succession with an interval of about two seconds between them.

(c)

A vessel not under command, a vessel restricted in her ability to manoeuvre, a vessel constrained by her draught, a sailing vessel, a vessel engaged in fishing and a vessel engaged in towing or pushing another vessel shall, instead of the signals prescribed in paragraph (a) or (b) of this Rule, sound at intervals of not more than two minutes three blasts in succession, namely one prolonged followed by two short blasts.

(d)

A vessel engaged in fishing, when at anchor, and a vessel restricted in her ability to manoeuvre when carrying out her work at anchor, shall instead of the signals prescribed in paragraph (g) of this Rule sound the signal prescribed in paragraph (c) of this Rule.

(e)

A vessel towed or if more than one vessel is towed the last vessel of the tow, if manned, shall at intervals of not more than two minutes sound four blasts in succession, namely one prolonged followed by three short blasts. When practicable, this signal shall be made immediately after the signal made by the towing vessel.

(f)

When a pushing vessel and a vessel being pushed ahead are rigidly connected in a composite unit they shall be regarded as a power-driven vessel and shall give the signals prescribed in paragraph (a) or (b) of this Rule.

(g)

A vessel at anchor shall at intervals of not more than one minute ring the bell rapidly for about five seconds. In a vessel of 100 metres or more in length the bell shall be sounded in the forepart of the vessel and immediately after the ringing of the bell the gong shall be sounded rapidly for about five seconds in the after part of the vessel. A vessel at anchor may in addition sound three blasts in succession, namely one short, one prolonged and one short blast, to give warning of her position and of the possibility of collision to an approaching vessel.

(h)

A vessel aground shall give the bell signal and if required the gong signal prescribed in paragraph (g) of this Rule and shall, in addition, give three separate and distinct strokes on the bell immediately before and after the rapid ringing of the bell. A vessel aground may in addition sound an appropriate whistle signal.

(i)

A vessel of 12 metres or more but less than 20 metres in length shall not be obliged to give the bell signals prescribed in paragraphs (g) and (h) of this Rule. However, if she does not, she shall make some other efficient sound signal at intervals of not more than 2 minutes.

(j)

A vessel of less than 12 metres in length shall not be obliged to give the above mentioned signals but, if she does not, shall make some other efficient sound signal at intervals of not more than 2 minutes.

(k)

A pilot vessel when engaged on pilotage duty may in addition to the signals prescribed in paragraphs (a), (b) or (g) of this Rule sound an identity signal consisting of four short blasts.

 

Rule 36

 

Signals to attract Attention

 

If necessary to attract the attention of another vessel any vessel may make light or sound signals that cannot be mistaken for any signal authorized elsewhere in these Rules, or may direct the beam of her searchlight in the direction of the danger, in such a way as not to embarrass any vessel. Any light to attract the attention of another vessel shall be such that it cannot be mistaken for any aid to navigation. For the purpose of this Rule the use of high intensity intermittant or revolving lights, such as strobe lights, shall be avoided.

Rule 37

 

Distress Signals

 

When a vessel is in distress and requires assistance she shall use or exhibit the signals described in Annex IV.

 

PART E — EXEMPTIONS

Rule 38

 

Exemptions — International

 

Any vessel (or class of vessels) provided that she complies with the requirements of the International Regulations for Preventing Collisions at Sea, 1960, the keel of which is laid or which is at a corresponding stage of construction before the entry into force of these Regulations is exempted from compliance therewith as follows:

(a)

The installation of lights with ranges prescribed in Rule 22, until four years after the date of entry into force of these Regulations.

(b)

The installation of lights with colour specifications as prescribed in section 7 of Annex I to these Regulations, until four years after the date of entry into force of these Regulations.

(c)

The repositioning of lights as a result of conversion from Imperial to metric units and rounding off measurement figures, permanent exemption.

(d)

(i) The repositioning of masthead lights on vessels of less than 150 metres in length, resulting from the prescriptions of section 3(a) of Annex I, permanent exemption.

(ii) The repositioning of masthead lights on vessels of 150 metres or more in length, resulting from the prescriptions of section 3(a) of Annex I, until nine years after the date of entry into force of these Regulations.

(e)

The repositioning of masthead lights resulting from the prescriptions of section 2(b) of Annex I, until nine years after the date of entry into force of these Regulations.

(f)

The repositioning of sidelights resulting from the prescriptions of sections 2(g) and 3(b) of Annex I, until nine years after the date of entry into force of these Regulations.

(g)

The requirements for sound signal appliances prescribed in Annex III, until nine years after the date of entry into force of these Regulations.

(h)

The repositioning of all-round lights resulting from the prescription of section 9(b) of Annex I, permanent exemption.

 

 

Rule 39

 

Special Signals for Dangerous Goods

 (a)

when not underway, exhibit where it can best be seen, an all-round red light or the International Code flag “B”; and

(b)

when underway, exhibit where it can best be seen, the International Code flag “B” but not an all-round red light.

 

Rule 40

 

Radar Reflectors

 

(a)

Subject to paragraph (b), a vessel that is less than 20 metres in length or is constructed primarily of non-metallic materials shall, if practicable, be equipped with a radar reflector or other means to enable the vessel’s detection by other vessels navigating by radar at 3 GHz or 9 GHz.

(b)

Paragraph (a) does not apply where

(i) a vessel operates in limited traffic conditions, daylight, and favourable environmental conditions and where compliance is not essential for the safety of the vessel, or

(ii) the small size of the vessel or its operation away from radar navigation makes compliance impracticable.

(c)

The radar reflector or other means to enable detection prescribed in paragraph (a) shall, to the extent practicable, meet the requirements of

(i) sections 3 to 5 of the Annex to Resolution A.384(X), made by the Organization and as amended from time to time, if fitted before July 1, 2005,

(ii) sections 3 to 5 of the Annex to Resolution MSC.164(78), made by the Organization and as amended from time to time, if fitted on or after July 1, 2005, or

(iii) other performance standards that the Minister determines provide a level of safety that is equivalent to or higher than that of those standards.

(d)

For the purpose of interpreting a document incorporated by reference into this Rule, “should” shall be read to mean “shall” and recommendations shall be mandatory.

Rule 41

 

Transponders

 

(a)

No vessel, except a vessel in distress, shall use a transponder that can transmit radar responder signals or radar beacon signals in the 3- or 10-centimetre marine radar bands.

(b)

Notwithstanding paragraph (a), an exploration or exploitation vessel may use such a transponder if authorized to do so under this Rule and the transponder is used in a manner that does not compromise the safety of navigation.

(c)

The Minister shall authorize the use of a transponder if it will be used in a manner that will not interfere with or degrade the use of radar in navigation, having regard to factors such as

(i) the proximity of other transponders and the distinctiveness of their signals,

(ii) the frequency, range and power of the transponder, and

(iii) the marine radar band to be used.

(d)

Rule 42

 

Additional Requirements for Exploration or Exploitation Vessels

 

(a)

An exploration or exploitation vessel shall display identification panels bearing the name, identification letters or numerals of the vessel so that at least one panel is visible in any direction.

(b)

The name, identification letters or numerals referred to in paragraph (a) shall be

(i) black,

(ii) not less than one metre in height,

(iii) displayed on a yellow background, and

(iv) easily visible in daylight and at night by the use of illumination or retro-reflecting material.

(c)

Subject to paragraph (h), an exploration or exploitation vessel, when stationary and engaged in drilling or production operations, shall, in lieu of the lights or shapes required by these Rules, exhibit where it can best be seen from any direction a white light or a series of white lights located at an equal height above the water and operating in unison, which light or lights shall

(i) flash the morse letter “U” at intervals of not more than 15 seconds,

(ii) be installed at a height above the water of not less than six metres and not more than 30 metres so that at least one light shall remain visible to within 15 metres of the vessel,

(iii) be visible all round the horizon at a nominal range of 15 miles,

(iv) be powered by a reliable power source,

(v) be equipped with an auxiliary power source, and

(vi) be exhibited from 15 minutes before sunset until sunrise and at all times when the visibility in any direction is two miles or less.

(d)

The horizontal and vertical extremities of an exploration or exploitation vessel that is stationary and engaged in drilling or production operations shall be adequately marked in compliance with the requirements set out in Transport Canada Standards Obstruction Markings (2nd ed.), 1987, TP 382, as amended from time to time.

(e)

An exploration or exploitation vessel, when stationary and engaged in drilling or production operations, shall be equipped with a sound-signalling appliance that

(i) is powered by a reliable power source,

(ii) is provided with an auxiliary power source,

(iii) when operating, emits a rhythmic blast corresponding to the Morse letter “U” every 30 seconds,

(iv) has its maximum intensity at a frequency between 100 and 1 000 Hertz,

(v) has a usual range of at least two miles,

(vi) is installed at a height above the water of not less than six metres and not more than 30 metres, and

(vii) is so placed that the sound emitted is audible, when there is no wind, throughout the required range in all directions in a horizontal plane from the vessel.

(f)

An exploration or exploitation vessel, when stationary and engaged in drilling or production operations, shall, whenever the visibility in any direction is two miles or less, operate the sound-signalling appliance described in paragraph (e) in lieu of the sound signal described in Rule 35.

(g)

An exploration or exploitation vessel shall comply with the relevant technical requirements set out in sections 2.3 and 2.4 of, and Appendix 1 to, the IALA’s publication Recommendations for the marking of offshore structures, as amended from time to time, and the nominal range of lights shall be computed in accordance with Appendix II of the IALA’s 1967 publication Recommendations for the notation of luminous intensity and range of lights.

(h)

For the purposes of this Rule, wherever the word “Authority” appears in a document incorporated by reference, it shall be read as “Minister”.

(i)

 

Rule 43

 

Safety Zones Around Exploration or Exploitation Vessels

 

(a)

For the purpose of this Rule, with respect to an exploration or exploitation vessel that is in position for the purpose of exploring or exploiting the non-living natural resources of the sea bed, a safety zone is the area that extends from the outer extremities of the exploration or exploitation vessel to the greater of

(i) 500 metres in all directions, and

(ii) 50 metres beyond the boundaries of the anchor pattern of the vessel.

(b)

The Minister may establish a safety zone greater than the safety zone referred to in paragraph (a) if it is reasonably related to the nature and function of the exploration or exploitation vessel and is necessary to ensure navigational safety.

(c)

No vessel shall navigate within a safety zone.

(d)

Paragraph (c) does not apply to a vessel that

(i) is in distress,

(ii) is attempting to save life or provide assistance to a vessel in distress,

(iii) is operated by or on behalf of the state having jurisdiction over the exploration or exploitation operations, or

(iv) has received permission from the person in charge of the exploration or exploitation vessel to enter the safety zone around that vessel.

(e)

Rule 44

 

Ocean Data Acquisition Systems (ODAS)

 

(a)

Every Canadian ODAS shall clearly display its identification number on an exterior surface where it can be clearly seen and, if practicable, shall display the name and address of the owner of the ODAS.

(b)

Subject to paragraph (f), every ODAS shall be constructed or fitted with a radar reflector, or other means, that has a radar response that at least meets the requirements set out in Rule 40.

(c)

Every ODAS that is designed to operate while floating with part of its structure extending above the water shall

(i) be coloured yellow,

(ii) have a shape that cannot be confused with the shape of a navigational mark, and

(iii) where technically practicable,

(A) have a topmark consisting of a yellow “X” shape,

(B) exhibit a yellow light visible at a minimum range of five miles that gives a group of five flashes every 20 seconds, and

(C) be equipped with an appliance that emits a sound signal at intervals of not more than two minutes, which sound signal cannot be confused with any other signal prescribed by these Rules or with the sound signal of any aid to navigation in the vicinity of the ODAS.

(d)

Subject to paragraph (f), every ODAS designed to operate under water, other than an ODAS referred to in paragraph (e), shall

(i) be escorted by a surface vessel that gives warning of the presence of the ODAS in accordance with Rule 27, or

(ii) have tethered to it a surface float that is marked, provides the radar response, is lighted and sounds the signals specified in paragraphs (a) to (c).

(e)

Every ODAS designed to operate when resting on the bottom of a sea, lake or river with part of its structure extending above the water shall be marked, exhibit lights and shapes, and sound signals in the same manner as an exploration or exploitation vessel.

(f)

Paragraphs (b) and (d) do not apply to an ODAS where

(i) the Minister has determined that the ODAS does not constitute a potential danger to navigation by reason of

(A) its size, material, construction, area or method of operation,

(B) the nature and condition of the waters in the area of operation of the ODAS, and

(C) the use that is or might reasonably be expected to be made of those waters, and

(ii) the Minister has given the owner of the ODAS notice in writing of that determination.

Rule 45

 

Blue Flashing Light

 

(a)

Any government vessel or any vessel that is owned or operated by a harbour, river, county or municipal police force may exhibit as an identification signal a blue flashing light when the vessel

(i) is providing assistance in any waters to any vessel or other craft, aircraft or person that is threatened by grave and imminent danger and requires immediate assistance, or

(ii) is engaged in law enforcement duties in Canadian waters.

(b)

Any vessel operated by the Canadian Coast Guard Auxiliary may exhibit a blue flashing light as an identification signal when the vessel participates, at the request of the Canadian Coast Guard, in search and rescue operations.

(c)

A vessel referred to in paragraph (a) or (b) that exhibits a blue flashing light as an identification signal is not relieved from the obligation to comply with the Steering and Sailing Rules set out in Part B.

(d)

Rule 46

 

Alternate System of Navigation Lights

 

(a)

For the purpose of this Rule, “alternate system of navigation lights” means a backup system that includes masthead lights, sidelights, a sternlight and the lights prescribed in Rule 30 for vessels at anchor.

(b)

This Rule does not apply to

(i) vessels that are less than 15 metres in length,

(ii) cable ferries, or

(iii) pleasure craft.

(c)

A Canadian vessel required by Part C to exhibit lights shall be fitted with an alternate system of navigation lights.

(d)

In the case of vessels built before January 1, 1991, that have a gross tonnage of less than 500, the alternate system of navigation lights may consist of oil or electronic lanterns.

(d.1)

[Repealed, SOR/2008-272, s. 35]

(e)

If it is impracticable for a vessel or object being towed or pushed to comply with paragraph (c), spare lights shall be readily available so that the vessel or object maintains compliance with Part C.

(f)

The alternate system of navigation lights shall be supplied by the main source of electric power and the emergency source of electric power that are referred to in section 15 of Annex I, unless otherwise provided by paragraph (g).

(g)

In the case of vessels built before January 1, 1991, having a gross tonnage of less than 500, the alternate system of navigation lights shall be supplied by

(i) the vessel’s emergency source of electric power, or

(ii) in the case of oil or electronic lanterns, power of a capacity sufficient for the duration of the intended voyage.

(h)

Lights using a flame shall not be used as the alternate system of navigation lights on any vessel carrying, towing or pushing cargo that is volatile or explosive.

 

ANNEX I

POSITIONING AND TECHNICAL DETAILS OF LIGHTS AND SHAPES

 

1. Definition — International

(a)

The term “height above the hull” means height above the uppermost continuous deck. This height shall be measured from the position vertically beneath the location of the light.

the horizontal sectors referred to in section 9 of this Annex and described in Rule 21.

 

2. Vertical positioning and spacing of lights — International

(a)

On a power-driven vessel of 20 metres or more in length the masthead lights shall be placed as follows:

(i) the forward masthead light, or if only one masthead light is carried, then that light, at a height above the hull of not less than six metres, and, if the breadth of the vessel exceeds six metres, then at a height above the hull not less than such breadth, so however that the light need not be placed at a greater height above the hull than 12 metres,

(ii) when two masthead lights are carried the after one shall be at least 4.5 metres vertically higher than the forward one.

(b)

The vertical separation of masthead lights of power-driven vessels shall be such that in all normal conditions of trim the after light will be seen over and separate from the forward light at a distance of 1 000 metres from the stem when viewed from sea level.

(c)

The masthead light of a power-driven vessel of 12 metres but less than 20 metres in length shall be placed at a height above the gunwale of not less than 2.5 metres.

(d)

A power-driven vessel of less than 12 metres in length may carry the uppermost light at a height of less than 2.5 metres above the gunwale.

(d.1)

Where a masthead light is carried in addition to sidelights and a sternlight or where the all-round light described in subparagraph (d)(i) of Rule 23 is carried in addition to sidelights, the masthead light or the all-round light shall be carried at least one metre higher than the sidelights.

(e)

One of the two or three masthead lights prescribed for a power-driven vessel when engaged in towing or pushing another vessel shall be placed in the same position as either the forward masthead light or the after masthead light, provided that, if carried on the aftermast, the lowest after masthead light shall be at least 4.5 metres vertically higher than the forward masthead light.

(f)

(i) The masthead light or lights prescribed in Rule 23(a) shall be so placed as to be above and clear of all other lights and obstructions except as described in subparagraph (ii).

(ii) When it is impracticable to carry the all-round lights prescribed by Rule 27(b)(i) or Rule 28 below the masthead lights, they may be carried above the after masthead light(s) or vertically in between the forward masthead light(s) and after masthead light(s), provided that in the latter case the requirement of section 3(c) of this Annex shall be complied with.

(g)

The sidelights of a power-driven vessel shall be placed at a height above the hull not greater than three-quarters of that of the forward masthead light. They shall not be so low as to be interfered with by deck lights.

(h)

The sidelights, if in a combined lantern and carried on a power-driven vessel of less than 20 metres in length, shall be placed not less than one metre below the masthead light.

(i)

When the Rules prescribe two or three lights to be carried in a vertical line, they shall be spaced as follows:

(i) on a vessel of 20 metres in length or more, such lights shall be spaced not less than two metres apart, and the lowest of these lights shall, except where a towing light is required, be placed at a height of not less than four metres above the hull,

(ii) on a vessel of less than 20 metres in length, the lights shall be spaced not less than one metre apart and the lowest of the lights shall, except where a towing light is required, be placed at a height of not less than two metres above the gunwale,

(iii) when three lights are carried they shall be equally spaced.

(j)

The lower of the two all-round lights prescribed for a vessel when engaged in fishing shall be at a height above the sidelights not less than twice the distance between the two vertical lights.

(k)

The forward anchor light prescribed in Rule 30(a)(i), when two are carried, shall not be less than 4.5 metres above the after one. On a vessel of 50 metres or more in length this forward anchor light shall be placed at a height of not less than six metres above the hull.

 

3. Horizontal Positioning and Spacing of Lights — International

(a)

When two masthead lights are prescribed for a power-driven vessel, the horizontal distance between them shall not be less than one-half of the length of the vessel but need not be more than 100 metres. The forward light shall be placed not more than one-quarter of the length of the vessel from the stem.

(b)

On a power-driven vessel of 20 metres or more in length the sidelights shall not be placed in front of the forward masthead lights. They shall be placed at or near the side of the vessel.

(c)

When the lights prescribed in Rule 27(b)(i) or Rule 28 are placed vertically between the forward masthead light(s) and the after masthead light(s) these all-round lights shall be placed at a horizontal distance of not less than two metres from the fore and aft centreline of the vessel in the athwartship direction.

(d)

When only one masthead light is prescribed for a power-driven vessel, that light shall be exhibited forward of amidships, except that a vessel of less than 20 m in length need not exhibit that light forward of amidships but shall exhibit it as far forward as is practicable.

 

 

5. Screens for Sidelights — International

The sidelights of vessels of 20 metres or more in length shall be fitted with inboard screens painted matt black and shall meet the requirements of section 9 of this Annex. On vessels of less than 20 metres in length the sidelights, if necessary to meet the requirements of section 9 of this Annex, shall be fitted with inboard matt black screens. With a combined lantern, using a single vertical filament and a very narrow division between the green and red sections, external screens need not be fitted.

5.1 Screens for Lights Other than Sidelights — Canadian Modification

On power-driven vessels of less than 12 metres in length, constructed after July 31, 1983, the masthead light or the all-round light referred to in Rule 23(d), shall be screened to prevent direct illumination of the vessel forward of the operator’s position.

 

6. Shapes

(a)

Shapes shall be black and of the following sizes:

(i) a ball shall have a diameter of not less than 0.6 metre,

(ii) a cone shall have a base diameter of not less than 0.6 metre and a height equal to its diameter,

(iii) a cylinder shall have a diameter of at least 0.6 metre and a height of twice its diameter,

(iv) a diamond shape shall consist of two cones as defined in subparagraph (ii) above having a common base.

(b)

The vertical distance between shapes shall be at least 1.5 metres.

(c)

In a vessel of less than 20 metres in length shapes of lesser dimensions but commensurate with the size of the vessel may be used and the distance apart may be correspondingly reduced.

 

7. Colour Specification of Lights — International

The chromaticity of all navigation lights shall conform to the following standards, which lie within the boundaries of the area of the diagram specified for each colour by the International Commission on Illumination (CIE).

The boundaries of the area for each colour are given by indicating the corner co-ordinates, which are as follows:

(i) White

9. Horizontal Sectors — International

(a)

(i) In the forward direction, sidelights as fitted on the vessel shall show the minimum required intensities. The intensities shall decrease to reach practical cut-off between one degree and three degrees outside the prescribed sectors.

(ii) For sternlights and masthead lights and at 22.5 degrees abaft the beam for sidelights, the minimum required intensities shall be maintained over the arc of the horizon up to five degrees within the limits of the sectors prescribed in Rule 21. From five degrees within the prescribed sectors the intensity may decrease by 50 per cent up to the prescribed limits; it shall decrease steadily to reach practical cut-off at not more than five degrees outside the prescribed sectors.

(b)

(i) All-round lights shall be so located as not to be obscured by masts, topmasts or structures within angular sectors of more than six degrees, except anchor lights prescribed in Rule 30, which need not be placed at an impracticable height above the hull.

(ii) If it is impracticable to comply with subparagraph (i) by exhibiting only one all-round light, two all-round lights shall be used suitably positioned or screened so that they appear, as far as practicable, as one light at a distance of one mile.

 

 

10. Vertical Sectors — International

(a)

The vertical sectors of electric lights as fitted, with the exception of lights on sailing vessels underway, shall be such that

(i) at least the required minimum intensity is maintained at all angles from five degrees above to five degrees below the horizontal,

(ii) at least 60 per cent of the required minimum intensity is maintained from 7.5 degrees above to 7.5 degrees below the horizontal.

(b)

In the case of sailing vessels underway, the vertical sectors of electric lights as fitted shall be such that

(i) at least the required minimum intensity is maintained at all angles from five degrees above to five degrees below the horizontal,

(ii) at least 50 per cent of the required minimum intensity is maintained from 25 degrees above to 25 degrees below the horizontal.

(c)

In the case of lights other than electric these specifications shall be met as closely as possible.

 

12. Manoeuvring Light — International

(a)

Notwithstanding the provisions of paragraph 2(f) of this Annex the manoeuvring light described in Rule 34(b) shall be placed in the same fore and aft vertical plane as the masthead light or lights and, where practicable, at a minimum height of two metres vertically above the forward masthead light, provided that it shall be carried not less than two metres vertically above or below the after masthead light. On a vessel where only one masthead light is carried the manoeuvring light, if fitted, shall be carried where it can best be seen, not less than two metres vertically apart from the masthead light.

(b)

Notwithstanding paragraph (a), in the waters of the Great Lakes Basin, the manoeuvring light referred to in Rule 34(i) shall be placed in the same fore and aft vertical plane as the masthead light or lights at not less than one metre vertically above or below the after masthead light and, where practicable, shall be placed at the minimum height of one metre vertically above the forward masthead light. On a vessel where only one masthead light is carried, the manoeuvring light, if fitted, shall be carried where it can best be seen and shall be located not less than one metre vertically apart from the masthead light.

13. High-speed Craft*

(a) The masthead light of high-speed craft may be placed at a height related to the breadth of the craft lower than that prescribed in subparagraph 2(a)(i) of this Annex, provided that the base angle of the isosceles triangles formed by the sidelights and masthead light, when seen in end elevation, is not less than 27°.

(b) On high-speed craft of 50 metres or more in length, the vertical separation between foremast and mainmast light of 4.5 metres required by subparagraph 2(a)(ii) of this Annex may be modified provided that such distance shall not be less than the value determined by the following formula:

 

y = [(a + 17?)C/1000] + 2

 

where

y          is the height of the mainmast light above the foremast light in metres;

a          is the height of the foremast light above the water surface in service condition in metres;

?          is the trim in service condition in degrees; and

C         is the horizontal separation of masthead lights in metres.

 

14. Approval — International

(a)

The construction of lights and shapes and the installation of lights on board a vessel shall be to the satisfaction of the appropriate authority of the State whose flag the vessel is entitled to fly.

 

15. Electrical Power Supply

Electric power, including emergency electric power, supplied to any navigation lights other than electronic lanterns shall be in compliance with the requirements of section 11.37 and the applicable provisions set out in Schedule 1 to Ship Electrical Standards, TP 127, published by Transport Canada, as amended from time to time.

 

ANNEX II

ADDITIONAL SIGNALS FOR FISHING VESSELS FISHING IN CLOSE PROXIMITY — INTERNATIONAL

 

1. General

The lights mentioned herein shall, if exhibited in pursuance of Rule 26(d), be placed where they can best be seen. They shall be at least 0.9 metre apart but at a lower level than lights prescribed in Rule 26(b)(i) and (c)(i). The lights shall be visible all round the horizon at a distance of at least one mile but at a lesser distance than the lights prescribed by these Rules for fishing vessels.

 

2. Signals for trawlers

(a) Vessels of 20 m or more in length when engaged in trawling, whether using demersal or pelagic gear, shall exhibit

(i) when shooting their nets: two white lights in a vertical line,

(ii) when hauling their nets: one white light over one red light in a vertical line,

(iii) when the net has come fast upon an obstruction: two red lights in a vertical line.

(b) Each vessel of 20 m or more in length engaged in pair trawling shall exhibit

(i) by night, a searchlight directed forward and in the direction of the other vessel of the pair,

(ii) when shooting or hauling their nets or when their nets have come fast upon an obstruction, the lights prescribed in paragraph 2(a) above.

(c) A vessel of less than 20 m in length engaged in trawling, whether using demersal or pelagic gear or engaged in pair trawling, may exhibit the lights prescribed in paragraph (a) or (b), as appropriate.

 

3. Signals for purse seiners

Vessels engaged in fishing with purse seine gear may exhibit two yellow lights in a vertical line. These lights shall flash alternately every second and with equal light and occultation duration. These lights may be exhibited only when the vessel is hampered by its fishing gear.

 

4. Special visual signals

In Canadian waters and fishing zones, a vessel engaged in pair — trawling shall exhibit at the foremast the International Code flag “T” during the daylight hours.

 

5. Special sound signals

(a)

In Canadian waters and fishing zones, a vessel engaged in fishing as described in sections 2 and 3 of this Annex shall, in any condition of visibility, sound the following signals on her whistle:

(i) four blasts in succession, namely, two prolonged blasts followed by two short blasts when shooting a net or gear,

(ii) three blasts in succession, namely, two prolonged blasts followed by one short blast when hauling a net or gear, and

(iii) four blasts in succession, namely, one short blast followed by two prolonged blasts, followed by one short blast when a net or gear is fast to an obstruction.

(b)

When in or near an area of restricted visibility, the signals described in paragraph (a) shall be sounded four to six seconds after the sound signal prescribed in Rule 35(c).

 

ANNEX III

TECHNICAL DETAILS OF SOUND SIGNAL APPLIANCES

 

1. Whistles — International

(a) Frequencies and range of audibility

The fundamental frequency of the signal shall lie within the range 70-700 Hz. The range of audibility of the signal from a whistle shall be determined by those frequencies, which may include the fundamental and/or one or more higher frequencies, which lie within the range 180-700 Hz (± 1%) for a vessel of 20 metres or more in length, or 180-2100 Hz (± 1%) for a vessel of less than 20 metres in length and which provide the sound pressure levels specified in paragraph (c) below.

(b) Limits of fundamental frequencies

To ensure a wide variety of whistle characteristics, the fundamental frequency of a whistle shall be between the following limits:

(i) 70-200 Hz, for a vessel 200 metres or more in length,

(ii) 130-350 Hz, for a vessel 75 metres but less than 200 metres in length,

(iii) 250-700 Hz, for a vessel less than 75 metres in length.

(c) Sound signal intensity and range of audibility

A whistle fitted in a vessel shall provide, in the direction of maximum intensity of the whistle and at a distance of 1 metre from it, a sound pressure level in at least one 1/3rd octave band within the range of frequencies 180-700 Hz (± 1%) for a vessel 20 metres or more in length, or 180-2100 Hz (± 1%) for a vessel less than 20 metres in length, of not less than the appropriate figure given in the table below.

The range of audibility in the table above is for information and is approximately the range at which a whistle may be heard on its forward axis with 90 per cent probability in conditions of still air on board a vessel having average background noise level at the listening posts (taken to be 68 dB in the octave band centred on 250 Hz and 63 dB in the octave band centred on 500 Hz).

In practice the range at which a whistle may be heard is extremely variable and depends critically on weather conditions; the values given can be regarded as typical but under conditions of strong wind or high ambient noise level at the listening post the range may be much reduced.

 

(d) Directional Properties

The sound pressure level of a directional whistle shall be not more than 4 dB below the prescribed sound pressure level on the axis at any direction in the horizontal plane within 45 degrees of the axis. The sound pressure level at any other direction in the horizontal plane shall be not more than 10 dB below the prescribed sound pressure level on the axis, so that the range in any direction will be at least half the range on the forward axis. The sound pressure level shall be measured in that 3rd-octave band which determines the audibility range.

 

(e) Positioning of Whistles

When a directional whistle is to be used as the only whistle on a vessel, it shall be installed with its maximum intensity directed straight ahead. A whistle shall be placed as high as practicable on a vessel, in order to reduce interception of the emitted sound by obstructions and also to minimize hearing damage risk to personnel. The sound pressure level of the vessel’s own signal at listening posts shall not exceed 110 dB (A) and so far as practicable should not exceed 100 dB (A).

(f) Fitting of more than one whistle

If whistles are fitted at a distance apart of more than 100 metres, it shall be so arranged that they are not sounded simultaneously.

(g) Combined whistle systems

If due to the presence of obstructions the sound field of a single whistle or of one of the whistles referred to in paragraph 1(f) above is likely to have a zone of greatly reduced signal level, it is recommended that a combined whistle system be fitted so as to overcome this reduction. For the purposes of the Rules a combined whistle system is to be regarded as a single whistle. The whistles of a combined system shall be located at a distance apart of not more than 100 metres and arranges to be sounded simultaneously. The frequency of any one whistle shall differ from those of the others by at least 10 Hz.

 

2. Bell or gong

(a) Intensity of Signal

A bell or gong, or other device having similar sound characteristics shall produce a sound pressure level of not less than 110 dB at a distance of one metre from it.

(b) Construction

Bells and gongs shall be made of corrosion-resistant material and designed to give a clear tone. The diameter of the mouth of the bell shall be not less than 300 mm for vessels of 20 metres or more in length. Where practicable, a power-driven bell striker is recommended to ensure constant force but manual operation shall be possible. The mass of the striker shall be not less than 3% of the mass of the bell.

 

3. Approval — International

(a)

The construction of sound signal appliances, their performance and their installation on board a vessel shall be to the satisfaction of the appropriate authority of the State whose flag the vessel is entitled to fly.

 

ANNEX IV

DISTRESS SIGNALS — INTERNATIONAL

 

1. The following signals, used or exhibited either together or separately, indicate distress and need of assistance:

(a)

a gun or other explosive signal fired at intervals of about a minute;

(b)

a continuous sounding with any fog-signalling apparatus;

(c)

rockets or shells, throwing red stars fired one at a time at short intervals;

(d)

a signal made by radiotelegraphy or by any other signalling method consisting of the group ... — -... (SOS) in the Morse Code;

(e)

a signal sent by radiotelephony consisting of the spoken word “Mayday”;

(f)

the International Code Signal of distress indicated by N.C.;

(g)

a signal consisting of a square flag having above or below it a ball or anything resembling a ball;

(h)

flames on the vessel (as from a burning tar barrel, oil barrel, etc.);

(i)

a rocket parachute flare or a hand flare showing a red light;

(j)

a smoke signal giving off orange-coloured smoke;

(k)

slowly and repeatedly raising and lowering arms outstretched to each side;

(l)

the radiotelegraph alarm signal;

(m)

the radiotelephone alarm signal;

(n)

signals transmitted by emergency position-indicating radio beacons;

(o)

approved signals transmitted by radiocommunication systems including survival craft transponders.

(p)

2. The use or exhibition of any of the foregoing signals except for the purpose of indicating distress and need of assistance and the use of other signals which may be confused with any of the above signals is prohibited.

3. Attention is drawn to the relevant sections of the International Code of Signals, the Merchant Ship Search and Rescue Manual and the following signals:

(a)

a piece of orange canvas with either a black square and circle or other symbol appropriate for identification from the air; and

(b)

a dye marker.
